<p class="MsoNormal"><span style="color:#1F497D">The Bureau of Labor and Industries (BOLI) has filed a
</span><a href="http://www.oregon.gov/boli/WHD/docs/ProposedRules/2018%2005%2007%20NoPR-Subs.pdf">Notice of Proposed Rulemaking and proposed
<span style="color:#1F497D">amended </span>rule</a><span style="color:#1F497D"> with the Secretary of State. The proposed rule amendment would make permanent an existing temporary rule which permits a public school district education service or public charter
school to provide rest and meal periods to substitute teachers in the same manner as they provide rest and meal periods to regular teachers whom the substitute teachers are replacing. While existing wage and hour regulations exempt salaried teachers from the
requirements to receive rest and meal periods, substitute teachers who replace a regular teacher are not exempt. Consequently, without the amendment, substitute teachers would be required to receive rest and meal periods in a manner that is not consistent
with the daily work schedules of the regular teachers whom they are replacing. Educational facilities confront significant obstacles in providing rest and meal periods to substitute teachers in a manner that differs from the daily work schedules of regular
teachers. <o:p></o:p></span></p>
