From Michael.Wiltfong at ode.state.or.us Thu Jul 1 16:46:35 2010 From: Michael.Wiltfong at ode.state.or.us (WILTFONG Michael) Date: Thu, 1 Jul 2010 16:46:35 -0700 Subject: [Busmgrs] Index of School Construction Tax Limits Message-ID: To: School District Superintendents and Business Managers From: Oregon Department of Revenue RE: School Construction Tax Limits for fiscal years 2009-10 and 2010-11 Background: Passed in 2007, SB 1036 allowed school districts to impose a tax on new construction measured by the square footage of improvements (affordable housing, public buildings, agricultural buildings, hospitals, private schools, and religious facilities are exempt). SB 1036 defined and required revenues to be used for capital improvements. Construction taxes imposed by a school district must be collected by a local government, local service district, special government body, state agency or state official that issues a permit for structural improvements regulated by the state building code. An intergovernmental agreement with local governments collecting the tax is required and collection expenses are limited to 4% of tax revenue. The Department of Consumer and Business Services (DCBS) is allowed to establish an administration fee of .25% of tax revenue. School districts with construction tax revenue are required to develop long-term facility plans. Construction taxes may be used for repayment of capital improvement debt. Tax Limit Calculations: SB 1036 set tax rate limits of $1 per square foot for residential use and $0.50 for nonresidential use, along with a $25,000 tax limit on nonresidential properties. Beginning in 2009, tax rates were indexed to inflation using the Engineering News-Record Construction Cost Index. As prescribed in statute, the Oregon Department of Revenue (DOR) is responsible for updating tax rate limits and notifying affected districts. To notify affected districts DOR has partnered with Department of Education who receives updated limit calculations from DOR and notifies the affected districts. Please note these are not in addition to the federal funds already incorporated into the budgets for 2009-10 and 2010-11 by the 2009 Oregon legislature. These funds are part of Oregon's original $570 million award from the State Fiscal Stabilization Fund (SFSF). There actually are two components of the SFSF award (i.e., sub-funds): $466 million from the Education Stabilization Fund and $104 million from the General Services Fund (used for the Department of Corrections budget). Prior to the recent award of $74 million, Oregon had been formally awarded $392 million from the Education Stabilization Fund. This $74 million brings the amount formally awarded to Oregon by USED to $466 million, the total Oregon is eligible to receive from the Education Stabilization Fund. The $74 million award was contingent upon successfully submitting a Phase II application for the State Fiscal Stabilization Fund. Oregon submitted its application in January of this year. The U.S. Department of Education recently notified us the application has been approved and, as a result, several announcements about the $74 million award came out. Again, these monies are not in addition to the funding already incorporated into the K-12 budget approved by the 2009 legislature. If you have any questions, please don't hesitate to contact the Department.
