As a result of sequestration, Oregon will lose around $23 million annually in federal education funds. These cuts represent a 5-7% reduction in federal funds for these programs (more precise estimates provided below). We know that you have a number of questions about how the sequester, and other reductions in federal spending, will impact your schools and districts. Below is a high level overview of the cuts Oregon will receive (by program type). Additional information and frequently asked questions on both Title I and IDEA cuts will be provided by the end of this week. We want to make sure the information we provide is both accurate and useful in your planning process. Thank you for your patience as we work to finalize information on how these cuts will roll out. What are the cuts? A number of federal education programs will receive cuts under the sequester. The main areas which will receive cuts are: * Funding for Oregon's high poverty schools * The state will lose approximately $10.2 million in Title I funding. * Funding for students receiving special education services under IDEA (Individuals with Disabilities Act) * The state will lose approximately $6.4 million in IDEA funds. As you know, districts are still required to provide services to students with disabilities so these cuts would likely impact other areas of education funding. * Funding for Head Start and Early Head Start programs * The state will lose approximately $3.5 million in funding for Head Start and Early Head Start programs. For additional information on federal Head Start cuts, please contact Nancy Hutchins at 206-615-3661 or nancy.hutchins at acf.hhs.gov. * Cuts to additional federal education programs (English Language Learner, Teacher Quality, etc.) * The state will lose approximately $3 million in funding related to other federal education programs. When will the cuts happen? Some sequester cuts will take effect immediately while others won't be implemented until the next funding cycle which begins in July, 2013. At this time, it is our understanding that the education cuts will not occur until the funding allocations for the 2013-14 school year, but we are still waiting for final confirmation of this. How will these cuts impact our students and schools? Precisely describing the impact of these cuts statewide is tricky as most budgeting decisions are made locally. The number of teaching positions cut will depend on decisions at the local level. Head Start cuts will be made through federal Head Start, not through ODE. The following provides our best guess as to the possible statewide impact of these cuts on our students and schools. * Based on current reports out of the Congressional Budget Office, districts would receive approximately 6.6% less in federal Title I funding and approximately 4.7% less in federal IDEA funding as a result of the sequester. These numbers are still subject to change, and we will share updates as available. * Around 220 teachers and educational aids would be at risk of losing their jobs as a result of the sequester. * The White House reports that hundreds of students would be removed from Federal Head Start and Early Head Start programs in our state due to the reductions to Head Start funding. * The Oregon Department of Education would see a reduction of federal funds used to administer federal programs and provide support and services to Oregon schools and districts. This reduction is anticipated to be around $1 million. * In addition to the cuts required under sequestration, funding for some federal programs was already expected to see slight reductions in the allocations for the 2013-14 school year. This will mean that districts will need to plan for larger cuts than those listed above. The total reduction for Title I for example (including both the planned allocation reductions and the sequester) is anticipated to be around 10%. We know that these cuts will be very painful to make. Your schools and districts have already cut deep over the last several years and these cuts will have a very real impact on the programs you offer and the students you serve. Thank you for your patience. We have a 2013-14 estimate. The reason for the delay has been the implementation of HB 3417 passed in 2011. This bill changes the way extended ADMw is calculated. The bill requires that charter school extended ADMw be calculated separately from the extended ADMw of the non-charter schools in the school district. The two numbers are then added together to determine the total extended ADMw for the district. The first major hurdle for implementation was determining what would be included in the extended ADMw for charter schools. There were differences of opinion of which weights belonged where. The Department asked the State Board of Education for rules to clarify how the legislation would be implemented. The State Board of Education passed OAR 581-023-0106 in June of 2012. Once the rules were established, work could begin on reprogramming the State School Fund for implementation. The challenge was that the State School Fund is not set up to separate individual schools within a district. Thus, the programming had to be almost completely redesigned to ensure that weights were assigned to both non-charter and charter schools in a district appropriately. We have finished that programming and are ready to roll out the new estimates. However, the estimates are not the same estimates as they too needed to be completely redesigned. The current estimate did not have room to show all of the individual charter schools, the weights assigned to the school, the weights assigned to the non-charter schools and the extended ADMw. The result is that each estimate is now in two parts. Estimate Part One: Summary Data The first part of the estimate most closely resembles what you have seen before. This is the summary data portion of the estimate. The top of the estimate continues to display local revenue and transportation grant costs. All of this information remains at the district level and will be displayed in each district's estimate. The middle section is the biggest change to the estimate. This section lists the individual charter schools and then adds a line for the combined non-charter schools in the district. The most noticeable change is that individual weights are not listed for each school in the district. Instead, the only information being displayed is the past year's ADMw, the current year's ADMw, and the extended ADMw for each charter school and the combined non-charter schools in the district. Because of size limitations, no individual weight data could be added to this part of the estimate. Thus, only the totaled ADMw data can be shown in this estimate. The rest of the estimate remains the same. The calculations for the general purpose grant, including the ratio, are shown. The total formula revenue, which includes the transportation grant, is then calculated. Finally the state school fund grant, which is total revenue less local revenue, is displayed. The amounts per ADMw are also still on the estimate. The biggest change to the estimate is that individual weights are not calculated for each district on this part of the estimate. There is simply no room to show the district weights and the charter school weights. The estimate cannot total the charter and non-charter school weights because that is not how extended ADMw is now calculated. Thus, only summary data is available on this part of the estimate. Estimate Part Two: Detailed Data The good news is that we are able to show the individual weights the non-charter and individual charter schools receive per district. The weights are distributed per OAR 581-023-0106. This is the second part of the estimate which shows the current year's weights for each charter school in the district as well as the total for the non-charter schools. The second part of the estimate does several things. First it lists all of the weights for each charter school as well as the weights for the combined district. Second, it lists the weights for the past year as well as the current year. Thus, each charter school in a district, as well as the non-charter schools in the district, will see each weight, the multiplier given to that weight, and the total weights added, for both the current year and the past year. The goal of the part of the estimate is to increase the transparency around weights and how they are distributed between the non-charter and charter schools in the district. To further transparency, each school's weights are listed by the current year as well as the past. Thus, you will be able to see how extended ADMw was calculated. Conclusion The goals of these new estimates are two-fold. First, we want the estimates to reflect HB 3417 and how charter and non-charter extended ADMw is now calculated. It is important that everyone understand what numbers are being used to form the extended ADMw of the district which forms the basis of the district's general purpose grant. The second goal is to increase transparency on how the weights are allocated between the district's non-charter and charter schools. It is important that districts understand which weights go directly to a charter school and which weights remain with the district. The second part of the estimate displays this distribution. It shows, in table form, how weights are distributed per OAR 581-023-0106. Thank you again for your patience in this implementation process. The programming and behind the scenes work was more complicated than originally contemplated. The results create a very different estimate than the one that everyone is used to. However, the new estimates continue the transparency around the formula of the old estimates and increase the transparency on how weights are distributed. What do we know about how the sequester will relate to the federal education budget for the coming school year? At this time, it seems most likely that a 2013 Continuing Resolution (CR) budget would be in place for the coming year. The CR budget would continue current 2013 funding at 2012 levels minus the 5% cuts from sequestration. The numbers in the chart above represent Continuing Resolution with the sequester reductions and are our best guess as to federal funding levels for the coming school year (2013-14). The U.S House passed its version of the CR budget on March 6, 2013. The U.S. Senate will likely take this up, and amend it, starting next week. Thus, there is still a possibility the numbers in the chart could change and drop further. When will these cuts take effect? We have been informed that these cuts will affect funding starting with the 2013 appropriations. There will be no change in 2012 appropriations. This was confirmed this week in a message directly from Arne Duncan, so we don't anticipate a change to this timeline. Will these cuts affect Maintenance of Effort? No. Sequestration does not change the underlying statutory requirements that govern program operations, including within-State allocation requirements. There is no change in maintenance of effort requirements, supplement not supplant rules, hold-harmless requirements, or State or local reservations of funding for required activities. How do the IDEA cuts impact FAPE? Districts are still required to provide a free and appropriate public education (FAPE) to students with disabilities. The IDEA funding reductions with therefore impact other areas of education funding so that districts can continue to provide the needed services. Will sequestration affect school improvement funding for the coming year? Funding for Title I-A school improvement comes from required set-asides within the State's Title I-A allocation. With a potential reduction, as a result of sequestration, funds for school improvement could be affected. It is too early to determine the exact impact sequestration will have on grants to Priority and Focus Schools. Given all of this, how should I plan my budget? Each district will need to consider its individual circumstances. Since we don't know how the U.S. Senate may amend the Continuing Resolution, a conservative approach would be to plan for up to a 10% reduction in federal education funding (around 5% from the sequester and perhaps up to 5% from possible allocation reductions). Congress failed to enact sufficient deficit reduction legislation so widespread cuts have been enacted to reduce the federal budget for Fiscal Year 2013 by $85 billion. The Office of Management and Budget compiled a detailed report of the percentage cuts for all affected programs. Interest subsidies to issuers of direct pay subsidy bonds (QSCBs, QZABs, RZEDBs, BABs) will be reduced by 5.1%. However, since there are only 7 months left in the federal fiscal year, issuers will see an 8.7% reduction to their next subsidy payment according to the IRS. If that was a bit of a head scratcher: 5.1% / (7/12) = 8.7%. Issuers should file for the full subsidy and the IRS will notify each issuer of their exact deduction. Issuers are required to make up the short-fall and the paying agent for your subsidy bonds will forward an invoice of the amount due prior to the interest payment date. Unfortunately there is still a high amount of uncertainty about what happens to the subsidies going forward. Will issuers be reimbursed at some point? Will the subsidies be restored to their full amount next year or will they be reduced by some percentage? Certain issues were sold with extraordinary redemption provisions in case the subsidy was reduced at no fault of the issuer. It may be possible to refund your subsidy bond with a tax-exempt issue and save money if the issue can be called at par and bond counsel determines an extraordinary event has occurred. What do we know about how the sequester will relate to the federal education budget for the coming school year? At this time, it seems most likely that a 2013 Continuing Resolution (CR) budget would be in place for the coming year. The CR budget would continue current 2013 funding at 2012 levels minus the 5% cuts from sequestration. The numbers in the chart above represent Continuing Resolution with the sequester reductions and are our best guess as to federal funding levels for the coming school year (2013-14). The U.S House passed its version of the CR budget on March 6, 2013. The U.S. Senate will likely take this up, and amend it, starting next week. Thus, there is still a possibility the numbers in the chart could change and drop further. When will these cuts take effect? We have been informed that these cuts will affect funding starting with the 2013 appropriations. There will be no change in 2012 appropriations. This was confirmed this week in a message directly from Arne Duncan, so we don't anticipate a change to this timeline. Will these cuts affect Maintenance of Effort? No. Sequestration does not change the underlying statutory requirements that govern program operations, including within-State allocation requirements. There is no change in maintenance of effort requirements, supplement not supplant rules, hold-harmless requirements, or State or local reservations of funding for required activities. How do the IDEA cuts impact FAPE? Districts are still required to provide a free and appropriate public education (FAPE) to students with disabilities. The IDEA funding reductions with therefore impact other areas of education funding so that districts can continue to provide the needed services. Will sequestration affect school improvement funding for the coming year? Funding for Title I-A school improvement comes from required set-asides within the State's Title I-A allocation. With a potential reduction, as a result of sequestration, funds for school improvement could be affected. It is too early to determine the exact impact sequestration will have on grants to Priority and Focus Schools. Given all of this, how should I plan my budget? Each district will need to consider its individual circumstances. Since we don't know how the U.S. Senate may amend the Continuing Resolution, a conservative approach would be to plan for up to a 10% reduction in federal education funding (around 5% from the sequester and perhaps up to 5% from possible allocation reductions). If there are no changes from your previous submission, your data have been saved and you can exit the collection. When you are finished with your edits, hit the "Save" button when ready to submit and this will overwrite any previous data entries. Thus, we are leaving 2010-11 as it was presented in the last estimate of May 9, 2012. We are doing this is to ensure continuity as far as 2010-11 is concerned. The ADMw breakout part of the estimate only breaks out 2011-12 ADMw. To review the breakout of 2010-11 ADMw, we ask that you review the previously published estimate, much as you did in the past. As far as 2011-12 is concerned, we continue to break out the ADMw into charter and non-charter schools to comply with the changes in the statute going forward. These numbers are broken out into their component parts and then added together and compared to calculate the extended ADMw of the district. Please remember that 2010-11 is kept at the district level and thus there is no ADMw break for that year nor is there a listing by charter and non-charter schools on the summary part of the estimate.
