Good Morning,
As you all know, there are two ways to obtain a Stalking Protective
Order:
1) An officer can issue a citation ordering the Respondent/Defendant to
appear in court based on the Petitioner/victim's statements. From there,
the court can determine if there is enough evidence to issue a Stalking
Order (ORS 163.738); OR
2) A victim, on his/her own, can ask the court for a Stalking Protective
Order (ORS 30.866).
I'm curious as to which happens more often in your respective county.
Thanks!
