[DV_listserv] Legal Summaries and Updates

Hi, All:

I've mentioned before what a great resource "AEquitas: The Prosecutor's Resource" can be; from time to time, I look at their website. This time, I found the summaries I've pasted below. The first two explain recent holdings by the US Supreme Court that impact the admissibility of hearsay statements under the Crawford line of cases.

The third summary deals with a recent case regarding a victims' rights issue. However, it also discusses the use of experts in Sex Abuse cases to explain victim behavior. Those of us who prosecute DV cases should be aware that the reasoning behind the admissibility of experts in sex abuse cases can and does apply equally to DV cases and can be just as helpful.

If you have a victims' rights issue, remember that the National Crime Victims Law Institute (NCVLI) and the Oregon Crime Victims Law Center (OCVLC) are extremely helpful. If you have a DV expert issue or question about how to admit expert testimony in a DV case, please don't hesitate to contact me.
