Welcome to NCVLI's Violence Against Women Digest!

In this digest, you will find some of the many news items affecting victims of sexual assault, domestic abuse, stalking, trafficking, and other crimes against women.




Case:


United States v. Graham, No. 12-CR-311, 2013 U.S. Dist. LEXIS 2992 (W.D. N.Y. Jan. 8, 2013)
Defendant was charged with three violations of federal sex trafficking laws, specifically the sexual exploitation of minor girls and women in commercial sex acts.   One of the victims was still a minor at the time of trial. The other two were 18 or older, although one had been a minor at the time of the trafficking. The government made a motion in limine seeking a protective order preventing the use of any of the victims' full names during the trial, and keeping confidential the identities of the minor victims. Defendant opposed the motion.   Under The Child Victims' and Child Witnesses' Rights Act, 18 U.S.C. § 3509(d)(3)(A), a protective order may be issued concealing the identity of a minor victim. On this basis, the court found it was appropriate to conceal the identity of the one minor victim. However, the court determined that it was appropriate to conceal the identities of all the victims, including the two adult victims, under additional statutory authority and case law. The court noted that the Crime Victims' Rights Act, 18 U.S.C. § 3771, provided statutory support for protecting these victims because it requires that crime victims be reasonably protected from the accused, and that they be treated with fairness and respect for their dignity and privacy. Additionally, referencing case law from multiple jurisdictions, the court stated that protective orders may be granted in favor of protecting an adult victim of sex trafficking because of the legitimate and substantial concern over "the likely adverse personal, professional, and physiological consequences of publically linking their identities to their past lives as sex workers."   Applying this general law to the facts of the case, the court found that all three victims' identities should be protected given the explicit nature of the testimony, concerns raised in the mental health evaluations, and possible safety issues. Although the court noted that the public did have a First Amendment interest in access to full information, here the possibility of detrimental effects of disclosure outweighed the First Amendment interest in disclosure.   Accordingly, the government's request for a protective order preventing the use and disclosure of the full names of the victims during trial was granted.

The recent reauthorization of the Violence Against Women Act is enabling Native American tribes to prosecute non-natives who commit domestic violence offenses on tribal land for the first time since 1817. While most tribes will not be able to begin such prosecutions until 2015, tribes can request permission from the Department of Justice to start earlier as part of a pilot project.

The governor of Kansas is expected to sign into law a new bill passed by the state's legislature to update the state's nearly decade-old human trafficking laws. The bill targets the problem of commercial sexual exploitation of underage women, and seeks to eliminate the word "prostitution" from the laws as part of an effort to recognize survivors of sex trafficking as victims. It will also establish a fund for survivors, financed by fines imposed on sex offenders.

Wisconsin is seeking to strengthen enforcement of its domestic abuse laws following the murder of a woman and two others by the woman's husband, who had never been arrested despite reports of abuse. Wisconsin is one of the 21 states in which it is mandatory for police to arrest domestic abusers. The state's legislature is seeking to implement measures to ensure police uphold the mandatory arrest law.

Critics say the "Healthy Marriage Act" currently being considered by the North Carolina legislature will put abused women at risk. The bill is intended to cut the state's divorce rate by requiring a two-year waiting period for divorce along with counseling sessions and a course on the effect of divorce on children. It contains no exception for cases of domestic violence.

A proposed Connecticut bill would expand the definition of "physically helpless" in its sexual assault laws to include someone physically unable to resist an act of sexual intercourse or contact. The bill comes after a contentious Connecticut Supreme Court decision which ruled that a conviction for sexual assault against a physically helpless person with cerebral palsy and mental retardation who could neither walk nor talk was invalid because the woman was not completely unable to express unwillingness.

Victims of domestic violence in New York may soon be entitled to a 90-day unpaid leave of absence. The New York State Senate labor committee passed Bill S.2509 on April 15, 2013. Under the bill, New York's labor law would be amended to give victims of domestic violence the right to take time off from work with job protection.
