Course Description: The Violence Against Women Reauthorization Act of 2013 (VAWA 2013) was signed into law on March 7, 2013. This Act amends existing federal laws and provides new tools for federal and tribal prosecutors dealing with domestic violence in Indian Country. Pursuant to VAWA 2013, tribes will be able to exercise their sovereign power to investigate, prosecute, convict, and sentence both Indians and non-Indians who assault Indian spouses or dating partners or violate a protection order in Indian country. VAWA 2013 also clarifies tribes' sovereign power to issue and enforce civil protection orders against Indians and non-Indians. This session will address how VAWA 13 amended the following statutes; the Indian Civil Rights Act, the Full Faith and Credit Statute, and the Federal Assault Statute.

Course Description: Strangulation crimes are prevalent; over 68% of domestic violence and sexual assault perpetrators have strangled their victim.  Moreover, as family violence professionals know and understand, intimate partner violence crimes, including strangulation assaults, are much more complex than crimes committed by strangers due to the history and relationship between the offender and the victim.  And while there has been research on the physical effects of strangulation, including signs and symptoms of the assault, there has not been extensive research conducted on the mental health effects of strangulation.


During this webinar, Detective Sylvia Vella, Psy.D, will discuss the study she conducted on the behavioral changes observed in survivors of strangulation assaults.  Sylvia will share common mental health and anxiety disorders seen in victims of strangulation, including post-traumatic stress disorder and an inability to focus or complete daily tasks, among other long-term health effects.  Sylvia will also discuss practical tools and strategies to employ when working with victims of strangulation, including screening for such an assault, discussing the effects of strangulation with the victim, and creating safety plans.

ADVANCED STRANGULATION COURSE

National Strangulation Training Institute Experts and Advisors, Det. Mike Agnew (Ret.) and Dr. Dean Hawley



This four-day Advanced Strangulation Course will be held August 27-30, 2013, in San Diego, CA.

The course will cover an in-depth examination of the basic strangulation course currently provided to multidisciplinary professionals, including the history and research of Domestic Violence and Sexual Assault Strangulation Crimes, and key aspects of the medical, law enforcement, and prosecution's response to strangulation cases.

The course will include effective training techniques and address how to develop a training curriculum so that attendees can enhance their understanding of adult learning styles. The course will also include a hands on opportunity to practice a short presentation in front of peers.
The second half of the course will discuss how to use experts in court, including tips for testifying, qualifying experts, and helpful tools and resources for both attorneys trying strangulation cases and the experts involved in such cases. This section of the course will follow a case scenario, in which the attorney and the expert will work together to develop the case, including developing a list of witnesses and demonstrative evidence to prepare for trial, cross-examination, and rebuttal. This section of the course will conclude with a mock trial.

Time for group discussions and brainstorming will be allotted throughout the entire training. Attendees will also be provided with relevant course materials and handouts. Continuing Education Credit will also be provided for attorneys (MCLE) and MFTs, LCSWs, LPCCs, and LEPs (CEU).
The Advanced Strangulation Course will be taught by faculty of the National Strangulation Training Institute, including Casey Gwinn, JD, Gael Strack, JD, Dr. Ralph Riviello, Brett Johnson, JD, Reena Becerra, MA, Det. Mike Agnew (Ret.), Dr. Sylvia Vella (Det.), and the Honorable Eugene Hyman.

Based on feedback, this course, unlike previous courses, will NOT be separated into two separate trainings.

Who Should Apply?

The course will be limited to fifty participants. Applicants will be considered based on:

  *   Office on Violence Against Women Grantee Status (Grants to Encourage Arrest, STOP, LAV, Rural Grantees);
  *   Experience working with family violence victims;
  *   Prior experience training domestic violence and sexual assault professionals; and
  *   Prior training on Strangulation Crimes presented by the National Strangulation Training Institute/Family Justice Center Alliance preferred
Due to the high demand for this course, OVW grantees attending in teams of at least two (prosecutor and subject matter expert) will have first priority; however, the NSTI recommends bringing a team of four from each community (prosecutor, law enforcement officer, medical representative, and advocate), if possible.

This training has been approved by the Office on Violence Against Women (OVW) for use of training funds for grantees to attend. In order to utilize this option, you must seek approval first from your OVW Program Manager.

Cost to Attend:
There is no cost to attend the training but travel costs, including transportation, lodging, and per diem are the responsibility of the participant.

The National Strangulation Training Institute will provide applicants with more detailed travel information once decisions are announced on June 27, 2013.
