Good Morning,
I wanted to alert you to a new bill that has been introduced. I won't be sending out alerts on every bill as they progress through the session, but this one is worth noting and keeping track of.
As you all know, in order for a Petitioner to obtain an RO, a court has to make many findings: that the Petitioner has suffered abuse w/I 180 days of the petition; that the Petitioner is in imminent danger of further abuse; and that Respondent presents a credible threat to Petitioner or the Petitioner's children.
This bill proposes that once an RO is granted it must include an automatic restraint against PETITIONER. See the summary below, and the link to the bill for its complete language and proposed sanctions.
SB 652
Establishes automatic restraining order against petitioner in Family Abuse Prevention Act proceeding that restrains petitioner from directly or indirectly causing respondent to violate certain terms of Family Abuse Prevention Act order. Violation by petitioner may result in finding of contempt and provides respondent with affirmative defense in contempt proceeding.
