Sadly, neither are attacks on a rape victim's credibility through arguments that the victim is not "acting like a victim". What is new, however, are the kinds of records being sought. Over the last year, NCVLI has worked with numerous partners to protect victims from invasions of the newest target -- their social media and text message accounts. In the most recent case, a military defendant, in possession of a photograph of the victim at the hospital that was posted on Facebook, is arguing that because the victim is smiling in the photo, she was not raped. Defendant is using this photograph as a basis to subpoena the victim's entire Facebook account, arguing that there may be other revealing photographs there. This argument is built upon a number of common rape myths, including the idea that there is a stereotypical or model rape victim. These arguments can be fought on many of the same grounds as other subpoenas: relevancy, admissibility, privacy, and other victims' rights.
