<p class="MsoNormal" style="text-autospace:none"><u><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">Unlawful Use of GPS:<o:p></o:p></span></u></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif""><o:p> </o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">SECTION 1. (1) A person commits the crime of unlawful use of a global positioning system<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">device if the person knowingly affixes a global positioning system device to a motor vehicle<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">without consent of the owner of the motor vehicle.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">(2)(a) Except as provided in paragraph (b) of this subsection, unlawful use of a global<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">positioning system device is a Class A misdemeanor.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">(b) Unlawful use of a global positioning system device is a Class C felony if, at the time<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">of the offense, the person:<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">(A) Has been previously convicted of stalking under ORS 163.732, violating a court’s<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">stalking order under ORS 163.750 or committing an equivalent crime in another jurisdiction;<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">or<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">(B) Is the subject of a citation issued under ORS 163.735, an order issued under ORS<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">30.866, 107.700 to 107.735 or 163.738 or another court order prohibiting the person from contacting<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">another person.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">(3) This section does not apply to:<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">(a) A police officer who affixes a global positioning system device to a motor vehicle<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">pursuant to a warrant or court order; or<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">(b) A person who affixes a global positioning system device to a motor vehicle operated<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:14.0pt;font-family:"Times New Roman","serif"">by a motor carrier.<o:p></o:p></span></p>
