Message-ID: <06D9FD985A42704BB0E8F483ACA3FE2E3F7A65BF4E@miranda.wesd.org> As many of you may remember, the Dept of Administrative Services applied for $1,224,775.83 in e-Rate discounts in FY2005. That application was denied due to the determination that some Letters of Agency were not obtained by DAS (when in fact they were). DAS immediately appealed the decision and for the last 4.5 years we have been waiting for the FCC to review the appeal and make their decision. Yesterday, the FCC announced that it was granting DAS's request for review (along with 10 other applicants), and remanded the application back to USAC for final review. The FCC agreed that DAS provided all the necessary LOA's and that the letters met all of the required criteria. USAC has 120 days to review the application again, ask any other questions that they feel they need to, and make a final funding decision. This is a VERY positive step forward, but it could still be months before we know for sure if any of the funding can be recovered. At a time where budgets cuts seem to never end, this is potentially wonderful news! As more information becomes available, I will let you all know. The Erratum contains mostly verbiage changes and does not address the complex questions we have been asking as of yet. Hopefully those answers are coming in future documents. However, the EDU2011 Pilot Program process has now been laid out, and a deadline for applications has been set at December 17th, 2010. The attached document outlines this process which includes a grant proposal plus an e-Rate Form 471. The required criteria for both schools and libraries are listed as well as the formal waiver of the competitive bidding process (Form 470) for off premise services. As you can see, there is not a lot of time given to create the proposals. You will also notice that the proposal deadline is prior to the anticipated opening of the Form 471 window, so the EDU2011 471's will be filed separately from the proposals. Please also note that the 471 for EDU2011 services must be separate from the 471 for your on premise services. Two important items to note: January 11th is the deadline for them to post the forms "before the opening of the 2011 application filing window", which may indicate that the window COULD open on the 11th or 12th. Also, in the 471 instructions, it states that the Item 21 attachments must be filed prior to window closing. This is a potentially big change for many of you. In any case, I do not recommend that applicants wait until January to file their 470's. There is no penalty for using the old form and it will save a lot of stress not doing it at the last minute. The final drafts of the forms and instructions, to be used for informational purposes only, accompany this public notice. They will be available for actual use by E-rate participants after being posted on USAC's website by January 11, 2011, before the opening of the 2011 application filing window.1 Applicants should NOT use the new forms until they are posted on USAC's website. On that date, applicants will be able to file electronically or download a copy of the revised forms from USAC's website, www.usac.org/sl. USAC will accept the previous FCC Forms 470 and 471, dated November 2004, for funding year 2011 and FCC Forms 470 that have already been filed do not need to be resubmitted. In addition, applicants that file the currently available Form 470, dated November 2004, will not have to have a technology plan for priority one services for funding year 2011, even though the certification at block 5, item number 21, indicates that such a technology plan is required.2 The Bureau submitted a revision of FCC Forms 470 and 471, collection 3060-0806, for OMB approval pursuant to 44 U.S.C. ? 3507 of the Paperwork Reduction Act (PRA) of 1995.3 The Bureau sought comment on the proposed changes July 1, 2010.4 The revisions streamline the forms by eliminating questions that are no longer useful and limit data collection to information that is not already available elsewhere. Also, the FCC Form 471 now requires information about the current number of broadband connections and their speeds and requires that the Item 21 attachment be submitted with the form. The forms also gather specific information about the type of entity filling out the forms or applying for E-rate funding. Finally, the forms are updated to reflect changes in program rules and citations.
