addition of the “any
use of computers” language is ambiguous at best. I agree with you that

implies that they mean ANY use that is occurring under the school’s
roof
no matter who owns the device. I don’t think that is what they mean to
say, but one can’t be too careful. If that were what they meant, they
would basically be shutting down the use of any and all smart phones
and
personal laptops on school or districts property, as there is no
reliable way
for a school or district to filter a connection that they don’t
control. <o:p></o:p></span></p>
<p class="MsoNormal"><span style="color: rgb(31, 73, 125);"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="color: rgb(31, 73, 125);">The
purpose of the NPRM is to
ensure that the language they use is clear and that the policy is as
fair as
possible. This is a perfect example of how an NPRM can facilitate
clarity in
the policy. It should be brought up in reply comments. I will recommend
to SECA
that we include it in our comments so that the FCC will hopefully
clarify their
position. I can imagine that others will do the same, as this would
cause a lot
of anxiety among schools and would basically turn libraries off to the
program altogether.<o:p></o:p></span></p>

Under III-B-10 it says, "...of the Act to require that the technology
protection measures be in operation during any use of computers with
Internet
access..." While obviously not new language, do you read that
section as directing that literally "any" computers will be subject
to the CIPA protection measures? More specifically, do you believe
in the process of clarifying the Act that computers (or anything that
could be
called a computer - even mobile devices like iphones) would need to be
filtered
while at the school? If this is the case, then we (districts/ESDs)
might
want to discuss the potential problem of adopting updated internet
safety
policies for compliance while knowing that we couldn't possibly control
a
personally-owned iphone or netbook with 3G service.<br>
<br>
Later in Appendix A (c)(1)(i) it also says, "...must also include
monitoring the online activities of minors." <br>
<br>
To my legally untrained eye there doesn't appear to be language or an
acknowledgment that the CIPA protection mandates can only be limited to
district-managed networks and computing devices. <br>
<br>
If I read this wrong just let me know and I'll consider it another
hallucination. <br>
