<div><font size="3">The American Recovery & Reinvestment Act (ARRA) H.R. 1, extends a moratorium on certain Medicaid regulations issued or proposed by the Centers for Medicare and Medicaid Services (CMMS) under the previous administration. Some of these regulations
would affect schools.</font></div>

<ul style="margin-top: 0pt; margin-bottom: 0pt; ">

<li>One rule would eliminate matching funds for transporting students with disabilities to and from schools on days they receive Medicaid services there. Another rule would eliminate matching funds for certain administrative costs in providing Medicaid services
to students known as the “administrative claiming” rule. This rule was issued in final form on 12/28/07, but Congress passed legislation 12/19/07 that prevented it from going into effect. <b>Under the stimulus bill, this moratorium which was set to expire
April 1, will now expire July 1, 2009.</b></li></font>

<div><font size="3">Another rule would eliminate matching funds for case management services that are “integral” to the management of a nonmedical program such as IDEA. This rule became effective 3/08, but Congress included a limited moratorium in legislation
passed in June 2008. <b>This moratorium also says the Center on Medicare and Medicaid Services cannot implement those parts of the rule that are more restrictive than the guidance </b><b>the act provides.</b></font></div>

<div><font size="3"><b>The ARRA also directs the Secretary of Health and Human Services not to promulgate as final the proposed Medicaid regulations published on August 13, 2007 (72 Federal Register 45201) related to rehabilitative services.</b></font></div>

<div><font size="3">The expected benefits to districts would be an extended period of time to collect at current fees.</font></div>
