Dear Public Health Administrators:
Today, the U.S. Food and Drug Administration (FDA) finalized a rule<http://www.fda.gov/TobaccoProducts/Labeling/RulesRegulationsGuidance/ucm388395.htm> extending its authority to all tobacco products, including e-cigarettes, cigars, hookah tobacco and pipe tobacco, among others. This historic rule helps implement the true vision for the Family Smoking Prevention and Tobacco Control Act of 2009. While the FDA chose to regulate conventional cigarettes under the 2009 Act, limiting flavors and marketing of conventional cigarettes, it did not regulate Other Tobacco Products the same way. The consequences have been serious and clear. E-cigarettes, hookah, and cigars have been largely unregulated, offered in a variety of flavors and heavily marketed in places where youth frequent. Between 2013 and 2015, Other Tobacco Product use among Oregon 8th graders doubled, and 11th graders increased 27%.*
In 2015, Oregon took additional steps to protect Oregonians from the harms of tobacco products. Oregon expanded the Indoor Clean Air Act (ICAA) to protect all Oregonians from the potential harms of e-cigarettes and other inhalants. Oregon is in the process of regulating packaging and labeling for inhalant delivery systems and will align Oregon rules with the new FDA regulations.
These FDA historic regulations improve public health and protect future generations from the dangers of tobacco use through a variety of steps, including restricting the sale of these tobacco products to minors nationwide.
The FDA will now be able to:
* Prohibit free samples;
* Require warning labels;
* Prevent misleading health claims by tobacco product manufacturers;
* Evaluate the ingredients of all tobacco products and how they are made; and,
* Communicate the potential risks of tobacco products.
These are important steps, and Oregon will continue efforts to protect Oregonians from the harms of tobacco.
The Public Health Division is evaluating what the new FDA regulations mean for Oregon and will hold a conference call, tomorrow, May 6th from 1:00 to 1:30 p.m. to discuss this development and collect questions you have. This is the first of many conversations we plan to have moving forward.
