Happy Friday! I hope this email finds you well. Thanks to those of you who joined on Wednesday for our TRL information session. I'm following up with some requested items here. (A reminder that the license does not apply to tribal lands, and Multnomah, Clatsop, Klamath, and Benton Counties plan to keep their existing licenses.)
* See below for an email that went out to Department of Revenue list subscribers a few weeks ago. A similar letter went out in the mail to all tobacco retail tax payers that week, which is their best list of "known" tobacco retailers.
* I've attached a copy of an OHA press release that went out around the same time.
* Below is also an email from Multnomah County to their tobacco retailers that went out 10/4.

You may also receive questions today about the Oregon Health Authority proposed tobacco retail license fee. We are sending out our draft rules to the Rules Advisory Committee, which includes the fee that will cover the costs of the program. OHA's proposed fee is $723, and DOR's fee will be $230, which brings the annual fee per retail location to $953. I know there will be a lot of questions about the fee amount and what will be provided to retailers in exchange. We plan to discuss in next week's Rules Advisory Committee meeting, and I've copied a few key talking points below in case those are helpful for you as well.

Fee Key Talking Points
* Starting on January 1, 2022, all tobacco retailers in Oregon must have a license to sell commercial tobacco and e-cigarette products. Retailers will pay a yearly fee to get their tobacco retail license.
* Oregon Health Authority and the Department of Revenue will use licensing fees to ensure robust customer service and support for local businesses, in addition to making sure businesses comply with the law.
* The Department of Revenue and Oregon Health Authority are committed to setting a fee that meets the standards set by the legislature and uses a cost-efficient approach to ensure retailers throughout the state have support to abide by all tobacco sales laws.
* The statewide tobacco retail license law includes real consequences for retailers that don't follow the law, such as suspending or revoking a retailer's ability to sell tobacco for repeated violations.
* A strong tobacco retail license promotes fair business practices by acknowledging retailers that follow the law while stopping and offering educational support to those that aren't.
* Tobacco use costs Oregonians approximately $2.9 billion a year.[1] A robust tobacco retail license program is a part of a comprehensive approach to reduce youth tobacco use, which will reduce the burden of tobacco-caused disease and death throughout Oregon.

Tobacco Retail Licensing Update
License required to sell tobacco or inhalant products starting January 1
Senate Bill 587 (2021) requires Oregon retailers selling cigarettes, tobacco, and/or inhalant delivery system products to obtain a license to sell these products beginning January 1, 2022. If your business is located in a jurisdiction with an existing tobacco retail license program, that jurisdiction may choose to continue to administer their program and you will continue to renew your license through that program.
If your business is in a jurisdiction that does not have or does not continue a local government tobacco retail license program, you will apply for a license from the Department of Revenue.
Jurisdictions with existing programs are still evaluating whether they will continue to administer their current retail tobacco license program or move to the state-administered tobacco retail license program.
The license requirement begins January 1, 2022, and the department will begin issuing licenses in early December to retailers located in those jurisdictions in which the state license applies. We will send a letter in November with instructions on how to apply for the license.
The department convened a rules advisory committee in September to solicit feedback from stakeholders related to rules necessary to implement the state license program. To receive updates on these rules, you can sign up on our website for our tobacco tax and/or our administrative rules email lists.
At this time, we don't have the information necessary to answer the most common questions like how much a license will cost or if the license will be issued by Oregon Department of Revenue, your city, or local public health authority.

As you may know, Oregon has adopted tobacco retail licensing into statewide law. Multnomah County anticipates continuing our responsibility to manage and implement local licensing. This means you will continue to hold a Multnomah County tobacco retail license and will NOT be required to apply for an additional state tobacco retail license. We are currently working with the Department of Revenue to enter an agreement to maintain Multnomah County Tobacco Retail Licensing. As a retailer of tobacco products in Multnomah County, we expect that you will only be required to hold the local license. We will continue to share information as this develops.
The Department of Revenue and Oregon Health Authority are working together to develop state tobacco retail licensing. The Department of Revenue is focused on licensing and renewal of tobacco retailers and the Oregon Health Authority is responsible for compliance and enforcement.
Last month, we shared an invitation from the Department of Revenue for the Rules Advisory Committee. That group met and discussed concepts of issuing a license for tobacco retailers. Now, the Oregon Health Authority is looking for stakeholders to participate in another Rules Advisory Committee:
The Oregon Health Authority is developing rules to implement the new tobacco retail license program. We are looking for community partners and stakeholders to serve as members of a Rules Advisory Committee.
The Rules Advisory Committee will meet up to three times in late October and early November to inform Oregon Health Authority's tobacco retail license rules.
