Hello!

The public comment period is open for interested individuals and organizations to submit comments on the revised Tobacco Retail Licensure rules, including refining the definition of "packaged in a manner attractive to minors" relating to packaging and labeling for inhalant delivery systems. These rules have been developed in coordination with Oregon's Department of Justice to ensure that administrative rules align with first amendment regulations according to Oregon's state constitution.

In considering ways that we can make commercial tobacco products less attractive to kids, evidence shows that eliminating flavored tobacco products is an important step. Flavored tobacco products are appealing to youth and young adults. Candy and other sweet flavorings make it easy for youth to start and addictive nicotine makes it hard to stop. Flavors, like packaging and label design, are part of the tobacco industry's marketing strategy to target kids with their harmful products. Prohibiting the sale of flavored tobacco products is a concrete step that we can take to reduce the number of youth who are exposed to nicotine.

The Oregon Health Authority (OHA), Public Health Division, Health Promotion and Chronic Disease Prevention section is proposing to permanently amend Oregon Administrative Rules in chapter 333, division 15 pertaining to the regulation of the retail sale of tobacco products and inhalant delivery systems.

In this rulemaking, OHA is proposing revised rules to clarify the overall language for the Tobacco Retail License (TRL) Program. The program has been conducting inspections and administering penalties for a year and has identified revisions needed to ensure consistent language and clarity throughout the administrative rules. Additionally, OHA is proposing to refine the meaning of "packaged in a manner attractive to minors" as it relates to inhalant delivery systems (IDS) (also known as e-cigarettes), as used in Oregon Administrative Rules (OAR) 333-015-0300 to 333-015-0360. This revision is to clarify the rules.
