<p class="MsoNormal">The Oregon Health Authority, Public Health Division (OHA-PHD), is proposing amendments to chapter 333, division 15, pertaining to inhalant delivery systems, such as e-cigarettes, packaged in a manner attractive to minors. The proposed amendments
clarify language related to inhalant delivery system packaging that is attractive to minors. <o:p></o:p></p>
<p class="MsoNormal" style="mso-margin-top-alt:auto;mso-margin-bottom-alt:auto">Tobacco products are sweet, cheap, easy to get and heavily promoted in the retail setting. The tobacco industry spends $1 million an hour on marketing in the U.S. and more than
$100 million in Oregon to promote and advertise cigarettes and smokeless tobacco products.<span style="font-size:12.0pt"><o:p></o:p></span></p>
<p class="MsoNormal">Inhalant delivery systems are of special concern, as they are marketed in ways to appeal to kids. E-cigarettes have candy-like packaging, come in sweet flavors, and are advertised or placed in locations frequented by youth, for example
near candy or at youth eye-level. They are heavily promoted in convenience stores and other locations accessible to youth. More than half of Oregon eighth-graders (59%) and 11th-graders (56%) shop in a convenience store at least once a week. In Oregon, e-cigarette
use among 11th graders increased three-fold from 2013 to 2015 from 5% to 17% (Oregon Tobacco Facts, 2018).<span style="font-size:14.0pt;font-family:"Times New Roman",serif"><o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:14.0pt;font-family:"Times New Roman",serif"><o:p> </o:p></span></p>
<p class="MsoNormal">OHA-PHD convened a Rules Advisory Committee (RAC) at the end of April this year to gather input and discuss inhalant delivery systems packaged in a manner attractive to minors. The RAC informed OHA-PHD’s proposed rules, which are attached.
You are invited to review and comment on the proposed rules. OHA-PHD is looking for comments from public health experts, particularly from jurisdictions that can provide local perspective.<o:p></o:p></p>
