The folks at the Secretary of State's Office were reviewing the Articles of Incorporation of the historic cemeteries listed with the Commission to let me know who would need to change their Articles of Incorporation to take advantage of the fee waiver.

Looks like all of them need to changes their articles of incorporation.

So...for 2010 ONLY...the Secretary of State's Office will waive the fee for these historic cemetery nonprofit to change their articles. You still need to fill out the form and follow the processes required in your bylaws. please see my previous email to get all of the forms you need. They are really hoping everyone will take care of this in 2010.

So in the end you will need to send three things with your annual report form - proof from me that the cemetery is listed as historic (a copy of certificate or letter you received when listed); The form to change the articles of incorporation; and a cover letter requesting the waiver of both fees based on being for the maintenance of a historic cemetery.

Let me know if you have any questions.
