<DIV aria-label="Compose body">I agree with your thoughts. The wording is always important. Perpetual care is excellent replacement for inflation. Our cemetery has good by laws but silent on the perpetual care cost. We have an annual meeting coming up and I can propose adding the perpetual care. Under Oregon law (ORS 97.710), cemeteries have the latitude to develop rules for the operation of their business. I've located ORS 97.710(1) The cemetery authority may make and enforce rules and regulations for: (a) The use, care, control, management, restriction and protection of its cemetery. </DIV>

Eventually a funeral establishment could pay us in advance using this service. Does the cemetery you are involved with have a website?</DIV>

<DIV><BR></DIV>Using of the word "inflation" is not good idea at all. They (the funeral <BR>establishment) resist easily. Use another word to describe the opening <BR>and closing of gravesite. You can always increase the fee to cover the <BR>'perpetual care" cost.<BR>

We are at somewhat of a disadvantage as a rural cemetery without onsite management. I'm formulating a plan to force funeral establishments that find ways to not pay the fee to pay it under Oregon law. You have the best idea getting payment in advance or perhaps when the grave space is sold. However, the fee to me is to help cover the cost of inflation and getting a fee at the time the grave site is sold may not be feasible if inflation is the reason. Also, being a city may give you a certain arm strength a small rural cemetery doesn't have but you are helping me in my endeavor<BR>><BR>> Rural and city cemeteries go under with cities being left to foot the bill of maintaining the cemeteries. This fee among others will help keep cemeteries from having to transfer ownership. Not being able to expand is the other reason So, I challenge the Historical Cemetery Board, State of Oregon and Oregon Mortuary and Cemetery Board to make it so funeral establishments and the like have to collect and remit an inflation fee to the cemetery.
