<p class="MsoNormal" style="margin-bottom:6.0pt">The Oregon Water Resources Department is undertaking rulemaking to update its Division 10 rules relating to the processes for establishing critical groundwater area (CGWA) designations and controls. The Department
invites interested persons to attend an upcoming informational session on December 16, 2021 from 1 PM to 3 PM to learn more about this rulemaking. Please see the attached agenda for additional information.

<b><u>RULEMAKING PURPOSE & SCOPE<o:p></o:p></u></b></p>
<p class="MsoNormal" style="margin-bottom:6.0pt">Division 10 governs the Department’s processes for establishing critical groundwater area (CGWA) designations and controls. These rules are currently out-of-date and inconsistent with the processes outlined
in statute (ORS 537.730 to 537.742). The Department is undertaking rulemaking to conform the rules to statute and provide a framework for implementing future CGWA designations and controls.

<p class="MsoNormal" style="margin-bottom:6.0pt">These rules <i><u>will not</u></i> create basin or sub-basin specific CGWAs, limit groundwater appropriation, or implement corrective control provisions. Once these rules are in place, future designations of
basin or sub-basin specific CGWAs will require a separate rulemaking process conducted in accordance with the provisions of these rules.
