Supporting Children, Youth, and Caregivers With Special Needs

Children, youth, and caregivers with diverse abilities can thrive when a continuum of supportive, cross-system prevention services in communities meets the self-identified needs of youth and families. Working in partnership with youth and families to develop effective and culturally responsive approaches is critical: Remember the mantra of disability rights activists and foster youth alike—nothing about us without us.

According to the Americans With Disabilities Act[1], state and local governments must:

  *   Ensure that people with disabilities have an equal opportunity to take part in programs, services, or activities, including making any necessary policy, practice, and procedure changes to allow their full participation. Reasonable modifications, such as allowing service animals regardless of pet policies, must be made so that people with disabilities can participate.
  *   Communicate effectively so that all people, regardless of ability, can fully understand what is being said or done. Communication aids, such as sign language interpretation and note-taking, must be provided as needed.

Facts

  *   Children and youth with special needs are vastly overrepresented in child welfare as well as intersecting systems, such juvenile justice[2]. Approximately 27 percent of children in care have a disability diagnosis[3].
  *   Children and youth with disabilities may be at increased risk of experiencing sexual abuse in out-of-home placements[4]. Harm may be compounded for youth of color with disabilities in foster care, who are already at risk of being pathologized, and for whom foster care may serve as a pathway to juvenile justice involvement[5,6].
  *   Relative caregivers are twice as likely to describe themselves as having poor health as nonrelative foster parents,[7] while 25 percent of grandparents raising grandchildren have a disability[8].
  *   A 2012 multistate survey indicated a 5 percent disability rate among Native American caregivers whose children were removed from their care by child welfare[9].
  *   As of 2016, two-thirds of state dependency statutes allow courts to determine a parent unfit, based on disability[10].

Resources

A robust array of services can support children, youth, and caregivers with disabilities, including physical, developmental, intellectual, and behavioral. Consider primary, secondary, and tertiary preventative supports such as:

  *   Economic and concrete supports to ensure that children, youth, and families with diverse abilities have the resources they need to thrive
  *   Cross-system supports such as access to health care and educational supports
  *   A network of community-based, culturally relevant treatment options that meet the needs of children, youth, and families with disabilities
  *   Placement options that keep children and youth connected to their families and communities—consider recruitment of kinship and therapeutic foster caregivers, as well as vital supports such as respite care
