The pernicious effects of implicit bias on the children we serve

I hope this finds everyone continuing to stay safe and healthy. Today, I want to turn your attention to a difficult topic—but one from which we cannot turn away. The intersection of racial bias and the criminal justice system in America is a complex, thorny web—and one we won’t fully untangle here. But there is an aspect of that—directly at the intersection of our work with families in our Children’s Advocacy Centers (CACs)—that we need to address, and it comes to us via a new research study.

I want to start by thanking the CAC for their willingness to participate in this research and face some very concerning findings. It’s only by our willingness to peel back the layers of our practice and examine the data that we can clearly see places where unconscious bias impacts our work and where we have to commit ourselves to addressing it.

In the study, titled “When Disclosure Fails to Substantiate Abuse: Child and Perpetrator Race Predict Child Sexual Abuse Substantiation<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=67ff2e03ab&e=24c6f7ba43>,”[1] in examining the influence of a child’s race on the likelihood that the allegation of abuse will be substantiated by child protective services (CPS), the researchers make one point absolutely clear at the outset—they are not talking about the effects of overt racism. Rather, what they are concerned with is the effect of “aversive racism—a modern form of racism in which individuals explicitly endorse egalitarian values but nonetheless harbor racist sentiments.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=5a5aea66f9&e=24c6f7ba43>., p. 2. This is what you might hear referred to as unconscious or implicit bias in other settings.

The existence of aversive racism is borne out by the research. For example, recent studies have shown that “White women were more punitive toward a hypothetical juvenile sex offender when he was alleged to have abused a girl portrayed as White than a girl portrayed as Black. … Other research supports the proposition that people perceive Black sexually abused children as more sexually mature and manipulative than White children.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=2e4f6d070c&e=24c6f7ba43>. And research has demonstrated that “adults and police officers perceive Black children as older than they really are and as older than identically aged White children—perceptions that drive beliefs that Black children are criminally culpable.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=26c935e71c&e=24c6f7ba43>.

Given all of this, the researchers in the present study wanted to examine the relationship between abuse disclosure, race, and abuse substantiation. To do so, they analyzed data collected from a CAC that serves a Midwestern community. The information, collected between 2016 and 2018, included a total of 315 cases. All information was de-identified and coded for child race, perpetrator race, whether the child disclosed during the forensic interview, and whether the abuse was substantiated. They anticipated finding the following: “that abuse substantiation would be less likely for cases involving children of color, as compared to White children.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=79be46586e&e=24c6f7ba43>., p. 3. They further expected to find that “abuse substantiation would be more likely for cases involving perpetrators of color, as compared to White perpetrators.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=651074cce2&e=24c6f7ba43>. Finally, they also “expected that the effect of abuse disclosure on increased abuse substantiation would be stronger for White children than for children of color.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=9c32d87b2c&e=24c6f7ba43>.

As the researchers had predicted, disturbingly, the data showed that “abuse substantiation was less likely for children of color than for White children.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=a6dd955098&e=24c6f7ba43>., p. 5. Importantly, “this effect was not explained by racial disproportionality in abuse disclosure rates because there was no child race effect on abuse disclosure likelihood.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=0e65d44ea2&e=24c6f7ba43>., pp. 5-7. In other words, children disclosed abuse at the same rate, regardless of race. Moreover, the researchers ruled out other possible confounding variables, such as the “relationship between child race and child gender, age, relationship with perpetrator, and length of time in between the alleged abuse and the forensic interview.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=c6c65a7b82&e=24c6f7ba43>., p. 7.

Not surprisingly, the researchers did find that “abuse substantiation was more likely in cases involving perpetrators of color than cases involving White perpetrators.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=375ccbaa3a&e=24c6f7ba43>. But the most shocking disparity involved the interaction between the child’s race and the rate of substantiation. While there was no child race effect on substantiation rates if a child did not disclose abuse, if a child did disclose abuse, “abuse substantiation likelihood decreased by 55% if the child was of color (vs. White).” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=007893c64b&e=24c6f7ba43>. The researchers are careful to note that, “given the correlational nature of the present study, it is difficult to discern whether the relationship between child race and abuse substantiation was causal.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=9f5e676af4&e=24c6f7ba43>. Nevertheless, they state, “[t]hese results are in keeping with existing experimental research revealing that sexually abused children of color are perceived as less credible (i.e., less believable) than their White counterparts.” Id<https://nationalchildrensalliance.us11.list-manage.com/track/click?u=f0eed4a49578b60fdd38f4745&id=89b756e463&e=24c6f7ba43>.

As we all know, a child’s disclosure is often the key piece of evidence in a case of child sexual abuse. If that disclosure is not considered credible or otherwise dismissed due to implicit bias, there are ripple effects all the way down the line for both the criminal and the civil justice systems. And, this is not just a problem that can be laid at the feet of CPS because they are the ones formally classifying the cases as substantiated or not, since presumably that decision was taken in concert with other professionals on the multidisciplinary team at the CAC.

We have to face these concerning results squarely. It’s through awareness of the pernicious effects of implicit bias that we can proactively set in place practices to ensure that we aren’t acting out if it when dealing with children and families. How might we conduct the post-interview debriefing differently now that we are aware of these research findings? How do we check ourselves and our assumptions both going into the forensic interview room and in the information-sharing afterwards when speaking about child victims of color? How do we conduct case review differently to ensure that the cases of children of color are given the attention they deserve? And how do we set data systems in place so that we actually know how our CAC and multidisciplinary team perform? These discussions are not easy—but they are so very vital to ensuring that every single child that passes through the doors of a CAC receives the care and attention they deserve and a fair shot at justice.
