Actually, EID's can be voluntary or involuntary. The confusion may lie in the initial establishment of the ordinance (I know it confused me!). The local government must develop and adopt an ordinance authorizing the EID. This is a two-step process. The first is a reading of the ordinance. The second step is to give a time period for remonstrance (property owners say they don't support the EID) before the adoption of the ordinance. If 33% or more "remonstrate" then the ordinance doesn't pass. With a voluntary system, property owners that formally opposed the EID are not obligated to pay the assessment. With the involuntary, if the ordinance passes, they are required to pay.

I would like to connect you with our Community Development Department Director who helped establish our EID/BID.  Our district is voluntary and I was of the impression that it had to be voluntary but Howard Schesser could help answer some of those questions, 541-942-3340.  I am attaching the letter that we send to new BID members of the district as a sample, EID would be similar but there is typically a lot less transition with EID.  I hope this helps. ~Kristin

We will be presenting the concept of an EID to the Hillsboro City Council on Feb. 21st and I was wondering of all of the jurisdictions that have EID’s in place are any of yours voluntary? I know in my mind it makes no sense to make it voluntary but if that is the only way to get it to pass that would be an alternative. I will be giving the City Council an EID 101 and I need to relay the info that an EID can be either voluntary or involuntary. I would like to be able to answer the question (if they ask) of those that exist how many are voluntary? Thanks in advance for your help.
