Darin,

In La Grande we don't purchase licensing unless the City is the host/organizer.  Historically from my Main Street days the license would be purchased by the host organization regardless of whether the venue was private or public property, basically whoever is paying the musician or collecting revenue from the performance has the liability of licensing the event.

I know that this issue has been a topic of frustration for years but honestly the process is annoying the cost is usually not that significant.  And I agree with you ,it's the right thing to do and should just be a part of the budget for events that include musical performances.

Good afternoon, everyone! Curious if any of your local governments procure BMI/ASCAP/SESAC licensing fees to cover royalties for public performances on publicly-owned property or right-of-way?

I know some jurisdictions expect event producers to cover those fees, but it seems that's not reasonable on an event-by-event basis, and I don't even know if a private organization could license an event that takes place on publicly-owned property.

Our City believes we should just let it ride "like every other City does". I look at it like a business license - it's the right thing to do, and we shouldn't be condoning businesses that aren't licensed. In the same way, we shouldn't be condoning public performances on public property without doing it the "right way".

Just wanted to see if there is a trend one way or another in how this is handled. Thanks, and have a terrific weekend!
