Actually, the EID fails if property owners representing 33 percent or more of the total assessment amount remonstrate. Take a look at the statute beginning at ORS 223.112 <a href="http://www.oregonlaws.org/ors/223.112">http://www.oregonlaws.org/ors/223.112</a>. Depending on your assessment method, owners of large properties can easily kill it. <br>

The local government must develop and adopt an ordinance authorizing the EID. This is a two-step process. The first is a reading of the ordinance. The second step is to give a time period for remonstrance (property owners say they <b>don't </b>support the EID) before the adoption of the ordinance. If 33% or more "remonstrate" then the ordinance doesn't pass. With a voluntary system, property owners that formally opposed the EID are not obligated to pay the assessment. With the involuntary, if the ordinance passes, they are required to pay.</div>

I know in my mind it makes no sense to make it voluntary but if that is the only way to get it to pass that would be an alternative. I will be giving the City Council an EID 101 and I need to relay the info that an EID can be either voluntary or involuntary.
