[Opds-contracts] Clarifying Message re Changes to OSH Discharge Timing

Good morning,

Attached to this email, please find a memo "Clarifying Changes to Discharge Timing of "Able" or "Never Able" Patients" from the Oregon State Hospital. The message below comes from OSH's Legal Affairs Director, Micky Logan.

'As explained in the attached, because of the high numbers of contested notices being filed because a party wants to keep a defendant at OSH but doesn't intend to contest the OSH evaluator's report finding, the process is being changed.  Specifically - beginning August 3rd - unless a party files a contested notice within two business days of the filing of the report and indicates in good faith that they intend to contest the conclusion of the OSH report, OSH will discharge the patient to the committing jurisdiction.

This is necessary so that OSH may continue to admit and discharge defendants in a timely way, rather than having beds taken up with defendants whom everyone agrees are  "able" or "never able."

This process does not impact a party's ability to contest a finding or ask for a hearing after the defendant has been discharged to the committing jurisdiction.'
