[OPEUreppms] Re-Employment Letter of Agreement Affecting SEIU Bargaining Units

TO: HR Directors/Managers of SEIU Represented Agencies

 

 

Attached is the signed Letter of Agreement to resolve the re-employment
of current employees' compensation issue that was brought to your
attention back in August 8, 2008.  Also attached is a example scenarios
that should assist you in complying with the new language.  

 

The LOA affects the compensation status of current employees who are
being reemployed into their former higher classification or into a
classification with a salary range that is between the demoted and their
former higher classification.  This LOA is applied to those employees
who are returning into the affected levels within 2 years from a
demotion.  This LOA does not apply to former employees being re-employed
from outside of State service (see Article 29, Section 9)

 

Remember that an employee who was regular status or trial service at the
time of demotion has that status restored.  In other words, if the
employees was in trial service prior to the demotion, the employee
completes the remainder of the trial service period pursuant to the
applicable provisions in Articles 49, 50, or 70 (Section 11 (3) (c).  If
the employee was in regular status, the employee retains the regular
status and does not serve a new trial service period upon reemployment.


 

 

Please forward this LOA to supervisors so they are aware of what
questions to ask the employee before an offer is made to the
candidate/employee of his/her status and compensation.  We encourage HR
involvement in this decision to ensure the correct information is
entered into the PPDB records, e.g., appointment type (promotion,
transfer, reemployment, etc.) and the appropriate compensation step, is
authorized pursuant to the LOA.
