[OSBAE] OSBAE Proposed Rulemaking Notice

Dear Colleagues and Interested Parties,

The Oregon State Board of Architect Examiners (OSBAE) is proposing amendments to Chapter 806 of the Oregon Administrative Rules (OARs). The attached Notice of Proposed Rulemaking includes one new rule and amendments to two existing rules.

The proposed changes are outlined in the attached notice and include the following:

  1.  OAR 806-010-0010(2) & (4) - Approved Architect and Firm Registration Evaluation Programs
Updates date references to the NCARB Certification and AXP Guidelines.
  2.  OAR 806-010-0037 - Architect Title
Clarifies the parameters of title use, including the disallowance of the use of the architect title when used to mislead or deceive consumers. Removes references to use of acronyms.
  3.  OAR 806-010-0014 - Criminal Conviction Determinations (New)
Creates a pre-registration determination process for those with criminal conviction(s) so that individuals with such histories can know if their background may impact their ability to become registered, prior to investing in an education program.

Comments may be submitted via email to architectboard at osbae.oregon.gov<mailto:architectboard at osbae.oregon.gov> or by mail to: OSBAE, 205 Liberty St. NE, Suite A, Salem, OR 97301. All comments must be received by 4:30 p.m. on September 22, 2025. An optional public hearing will occur on September 16, 2025. Information about how to submit comments is contained in the attached notice.

In accordance with guidance from Governor Kotek's office regarding transparency in rulemaking, please be aware that public comments will be posted on the OSBAE website. All submitted comments will also be reviewed by the Board at its next scheduled meeting following the close of the comment period.
