<p class="MsoNormal"><span style="font-family:"Times New Roman","serif"">The Oregon State Marine Board adopted rules for Foam Encapsulation and Mufflers, and accepted a petition for an electric motor only, 5 MPH speed limit for Ford’s Pond in Douglas County.
The Board tabled rule adoption for the Fly Creek Inlet on Lake Billy Chinook in Jefferson County. Furthermore, agency staff reviewed legislative concepts and solicited Board direction.<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Times New Roman","serif""><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Times New Roman","serif"">The Board repealed the Foam Encapsulation rules in Division 014 and adopted new Foam Encapsulation rules, OAR 250-010-0700 to OAR 250-010-0715, in statewide rules, Chapter 250, Division
10. The changes include removing treated wood as an approved material and method to encapsulate foam flotation for new construction or additions and increasing the minimum thickness of encapsulation with plastic sheets from 7 mm to 10 mm. The rules also
remove the requirement for individuals to obtain certification to place encapsulated foam flotation on the water. This rule goes into effect on January 1, 2019.

<p class="MsoNormal"><span style="font-family:"Times New Roman","serif""><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Times New Roman","serif"">The Board adopted updates to the Muffler rules, OAR 250-010-0121. The rule allows for law enforcement to take shoreline sound measurements at a standard of 84 dBA for boats that are underway
for violations of the noise standards and being effectively muffled. The rules also clarify stationary tests already used by law enforcement.

<p class="MsoNormal"><span style="font-family:"Times New Roman","serif""><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Times New Roman","serif"">Additionally, the Board approved a petition to open rulemaking on Ford’s Pond in Douglas County, OAR 250-020-0102, to consider prohibiting the use of motorboats, except those propelled
by electric motors, and setting a 5 mph speed limit on the pond. <o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Times New Roman","serif""><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Times New Roman","serif"">The Board tabled rules for boat operations in Jefferson County for the Fly Creek Inlet, OAR 250-020-0161. The Board directed staff to reinitiate the rulemaking process. The Board will
conduct a public rule hearing for the Fly Creek Inlet at its April 18 Board meeting.
<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Times New Roman","serif""><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Times New Roman","serif"">Agency staff presented the Board with preliminary legislative concepts for the 2019 session and solicited prioritization. Concepts the Board approved pursuing include: expanding definitions
for floating properties, law enforcement authority for the aquatic invasive species program, boater education card exemptions and penalties, livery registration, updating language for reckless boating and reducing fines for life jacket violations, definitions
and program administration updates for the outfitter/guide program, and waterway access account. Staff will continue consulting with Boat Oregon Advisory Teams and other stakeholders to refine the concepts.
