intent of this guide is to ensure that when drafting arbitration and settlement
agreements that any intended payment will meet the desired outcome for both the
agency and the employee/former employee. It provides situations and
standardized language that will provided clarity as to whether the payment will
be considered PERS subject or non-subject salary, and would then require the
payment of PERS contributions or not.</span></font><o:p></o:p></p>
<p><font size=2 face=Tahoma><span style='font-size:10.0pt;font-family:Tahoma'>Additionally,
any payments paid through the Oregon State Payroll Application (OSPA) need to
be coded correctly to indicate for PERS reporting whether the payment is
intended to be PERS subject or non-subject salary. For PERS subject salary
agencies will continue to use OSPA Code "SAD". For non-subject
salary agencies need to use the new OSPA Code "GSD". </span></font><o:p></o:p></p>
<p><b><font size=2 face=Tahoma><span style='font-size:10.0pt;font-family:Tahoma;
font-weight:bold'>To ensure compliance with PERS statute and rule on the
treatment of the payment, a copy of the final signed agreement needs to be sent
