At the end of the day, Republican and Democratic leaders were able to get past their barbs and come up with a deal that could keep the federal government renewing passports, refunding taxes and paying the troops. Still, both Republicans and Democrats are girding for the next wars: the vote to raise the debt ceiling that'll come this spring and could lead to the first federal default in American history if the tea party prevents it from being raised. Within moments of President Obama hailing the deal that was struck, the Senate Minority Leader, Mitch McConnell, R-KY, said he hoped that the debt limit vote would be an occasion for more spending cuts. And then there is next year's budget where the House Republicans are already pushing the plan developed by Rep. State and Local News On Average, Governors' Salaries Show Decline in Pay Just like American workers, whose pay has slipped in recent years, the average salary of U.S. governors also has begun to slide. According to the Council of State Governments' most recent compensation survey, the average governor's salary was $130,595 in 2010 ? down 4 percent from the year before. Much of that decline is attributable to California, which reduced its governor's salary from $212,179 in 2009 to $173,987 in 2010. Pay for top state executives in California is set by the Citizens Compensation Commission. According to Chairman Chuck Murray, the state's ongoing budget problems forced the commission to reduce salaries across the board substantially. He expects another reduction of perhaps 10 percent or more this year. "We're broke," Murray says. "It's no more difficult than that." ?David Combs, Stateilne.org. Read more. Oil Price Brings Alaska $3.4 Billion Surplus Alaska is rolling in money from the high oil prices, with the revenue department on Wednesday projecting a state surplus of $3.4 billion. The news comes as the Legislature prepares to decide how much it wants to spend on construction and maintenance projects in the coming year. Lawmakers had already planned a big budget, but this could inspire even more projects. Legislators also are talking about putting more than $1 billion into savings in the coming year. The question will be how they divide the new projected $3.4 billion surplus between spending and savings. Other states are reeling from the recession and cutting programs. The U.S. Appeals Court in New Orleans yesterday affirmed all of Skilling's convictions. The three-judge panel said the trial judge made a harmless error in allowing the jury to convict Skilling for conspiracy on a so-called honest-services fraud theory as well as on a securities-fraud theory. Transit Tax Reminder (additional wages subject to transit taxes): All wages earned by employees, whether they are resident or non residents of Oregon, who work in either the Portland Metropolitan or the Eugene/Springfield areas are subject to transit taxes. These are employer taxes based on the employees gross income for services physically performed in either district, and not deducted from the employee's paycheck. Wages include salaries, commissions, bonuses, fees or other items of value that are paid to an employee for services they perform. (the employer must calculate the fair market value of any non monetary compensation) Even if the main business location is not in either transit district, if employees work on job sites or make client contacts in either district, their wages would be subject to transit taxes for the time they are working in the transit district. Wages subject to transit taxes but often missed include: A. Tip Income: Becomes subject to transit taxes when it is paid by the customer to the business, who then distributes the payment to the employees. B. Sick pay: Becomes subject when paid by the employer C. Vacation pay: subject to transit taxes. (May need to be prorated if based on work performed inside and outside the district) D. Meals and Lodging: Is subject if not furnished for the convenience of the employer and on the employers? premises, or as a condition of hire. E. Agricultural Employees: Wages earned for such activities as canning, retail work (such as working in the on site nursery), food processing and other related services are subject when performed in the transit district. ****ONLY work connected with the planting, cultivating, and harvesting of seasonal agricultural crops is exempt. (Seasonal crops are defined as crops that mature within a year, from planting to harvesting) F. Wages paid to family employees are subject (such as spouses, or children under 18 years of age hired by their parents). E. Payments made by corporations, (including S-Corps.) to corporate officers as compensation for services performed in the transit districts are subject to transit payroll taxes, even when the corporation was created outside the state of Oregon, and/or the officers are non residents of Oregon. F. Compensation paid to the individual partners of a partnership is subject to transit self employment taxes. (The partnership itself is not subject: the individual partners are.) G. Dismissal or Severance pay is subject. (May need to be prorated if based on work performed both inside and outside the district) H. Employees working in private homes converted for business use, such as an adult foster care facility or day care facility, are subject if the home/business is located in the transit tax districts. IRS Announces Qualified Disaster Treatment for Japan http://www.irs.gov/newsroom/article/0,,id=238173,00.html The Internal Revenue Service today issued guidance that designates the earthquake and tsunami in Japan in March 2011 as a qualified disaster for federal tax purposes. This guidance affects recipients of disaster relief payments as well as employer-sponsored private foundations. The guidance allows recipients of qualified disaster relief payments to exclude those payments from income on their tax returns. Also, the guidance allows employer-sponsored private foundations to assist employee victims in areas affected by the March 2011 earthquake and tsunami in Japan without affecting their tax-exempt status. The Patient Protection and Affordable Care Act of 2010 expanded information reporting to include payments to corporations, ?amounts in consideration of property,? and ?other gross proceeds? made in the course of a trade or business (including operation of a governmental entity), beginning in 2012. The new law repeals these requirements. You are not required to file Form 1099-MISC for these payments for any year. Existing information reporting requirements remain in effect. Payments of $600 or more for nonemployee compensation made in the course of a trade or business are generally required to be reported on Form 1099-MISC. Certain payments to corporations are required to be reported. See the Instructions for Form 1099-MISC for more information. The Small Business Jobs Act of 2010 provided that anyone receiving rental income from real estate would be treated as receiving income from a trade or business of renting property; therefore, information return requirements applicable to small businesses would be in effect. This provision also is repealed; you are not considered to be in a trade or business solely because you receive rental income. See Publication 527 for more information on rental income and expenses.
