Taxpayers affected by the delay they can begin preparing their tax returns immediately because many software providers are ready now to accept these returns. Beginning Feb. 14, the IRS will start processing both paper and e-filed returns claiming itemized deductions on Schedule A, the higher education tuition and fees deduction on Form 8917 and the educator expenses deduction. Peomany major software providers have announced they will accept these impacted returns immediately. The software providers will hold onto the returns and then electronically submit them after the IRS systems open on Feb. 14 for the delayed forms. Taxpayers using commercial software can check with their providers for specific instructions. Those who use a paid tax preparer should check with their preparer, who also may be holding returns until the updates are complete. Most other returns, including those claiming the Earned Income Tax Credit (EITC), education tax credits, child tax credit and other popular tax breaks, can be filed as normal, immediately. The IRS needed the extra time to update its systems to accommodate the tax law changes without disrupting other operations tied to the filing season. The delay followed the Dec. 17 enactment of the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010, which extended a number of expiring provisions including the state and local sales tax deduction, higher education tuition and fees deduction and educator expenses deduction. Free Tax Help Available Nationwide http://www.irs.gov/newsroom/article/0,,id=235201,00.html Over 12,000 free tax preparation sites will be open nationwide this year as the Internal Revenue Service continues to expand its partnerships with nonprofit and community organizations providing vital tax preparation services for low- to moderate-income and elderly taxpayers. The Tax Counseling for the Elderly (TCE) Program offers free tax help to taxpayers who are 60 and older. For taxpayers who want to prepare and e-file their own tax returns, there is IRS Free File. Individuals or families with 2010 adjusted gross incomes of $58,000 or less can use Free File software. Free File Fillable Forms, the electronic version of IRS paper forms, has no income restrictions. For either service, taxpayers must go through www.irs.gov/freefile to access the programs. Relief for Tax Return Preparers Who Have Pending PTIN Applications http://www.irs.gov/pub/irs-drop/n-11-11.pdf Notice 2011-11 provides relief by allowing tax return preparers who have made a good faith effort to obtain a PTIN to prepare tax returns for compensation even though they have not received a PTIN. Notice 2011-11 will appear in IRB 2011-7 dated Feb. 14. Taxpayers Who File Electronically Must Use e-Signatures http://www.irs.gov/newsroom/article/0,,id=234470,00.html In an effort to make electronic filing even more secure and paperless, the Internal Revenue Service now requires all taxpayers who file their tax returns electronically to also use electronic signatures. The IRS has eliminated the paper signature document for e-filed returns. Just as the familiar automated teller machines use personal identification numbers, so does the IRS e-signature process. If filing a joint return, each taxpayer must create and use his or her own PIN to sign the tax return. The IRS also must verify your identity so there will be personal and tax-related questions. You should have your prior year 2009 tax return on hand if it's available. There are two ways to create an IRS e-signature PIN: self-select PIN method and practitioner PIN method - see the full article for more details. Why Employees and Retirees May See Changes in 2011 Payments and Withholding http://www.irs.gov/newsroom/article/0,,id=235813,00.html The Tax Relief, Unemployment Insurance Reauthorization and Job Creation Act of 2010, enacted on December 17, 2010, included several changes impacting workers? take-home pay and retirees? net pension checks for 2011. The Tax Relief Act extended for two years the income tax rates that were scheduled to expire at the end of 2010; that extension prevented a large increase in federal income tax withholding. However, the new law did not extend the Making Work Pay (MWP) credit that had been available for tax years 2009 and 2010. While most workers qualified for the maximum MWP credit, pension recipients did not qualify for any MWP credit unless they also had wages or other earned income. In December 2010, the IRS published new federal income tax withholding information to reflect the impact of the Tax Relief Act. The fact that the MWP credit expired, by itself, would have resulted in increased withholding for most taxpayers. However, under the Tax Relief Act, withholding for social security tax for all wage earners was reduced from 6.2% to 4.2% (withholding for Medicare, at 1.45%, did not change). For most employees, the net effect of these two changes will result in less total tax being withheld from their checks. The social security tax reduction does not affect pension payments. Due to the late enactment of these tax law changes, the IRS asked employers and plan administrators to adjust their systems as soon as possible but not later than January 31, 2011. This means employees and pension recipients may not have seen the full impact of these changes until their first paycheck in February, 2011. Once employers implement the changes, there will be a net increase in take-home pay for most employees (excluding the impact of any other withholding amounts, such as withholding for health insurance, state income taxes, etc.). Once pension plan administrators implement the 2011 changes, the retirement check payments for some pensioners may be lower depending upon the method that their plan administrators used to calculate withholding in 2010. Second Special Voluntary Disclosure Initiative Opens; Those Hiding Assets Offshore Face Aug. 31 deadline http://www.irs.gov/newsroom/article/0,,id=235695,00.html The Internal Revenue Service announced today a special voluntary disclosure initiative designed to bring offshore money back into the U.S. tax system and help people with undisclosed income from hidden offshore accounts get current with their taxes. The new voluntary disclosure initiative will be available through Aug. 31, 2011. The IRS decision to open a second special disclosure initiative follows continuing interest from taxpayers with foreign accounts. The first special voluntary disclosure program closed with 15,000 voluntary disclosures on Oct. 15, 2009. Since that time, more than 3,000 taxpayers have come forward to the IRS with bank accounts from around the world. These taxpayers will also be eligible to take advantage of the special provisions of the new initiative. IRS FY 2012 Budget Proposal Summary http://www.irs.gov/newsroom/article/0,,id=235959,00.html The Administration?s FY 2012 budget request for the Internal Revenue Service is nearly $13.3 billion, a $1.1 billion increase from the FY 2010 budget. Because of the IRS?s unique function as the revenue center of government, this budget increase actually reduces the deficit through increased tax enforcement revenues. In FY 2010, the IRS collected $2.345 trillion in taxes, representing 93 percent of federal government receipts. The IRS processed 141 million individual tax returns in 2010 and issued 109.5 million in refunds worth $366 billion. The IRS 2012 funding request reflects a continued commitment to balance taxpayer service with fair enforcement of the tax laws. The IRS will also continue to invest in its service program, with particular emphasis on online services. At the same time, the IRS continues to run a disciplined operation, identifying more than $188 million in cost-savings in 2012, coming on top of similar efficiency savings in 2010 and 2011. Combined Payroll Tax Booklet: The Combined Payroll Tax Booklet will go out around mid February. You should receive it by the end of the month. However, if you don?t receive it by the first week of March, be sure to contact us. Chances are we may need to update your mailing address to resend the booklet to you. II. Form WR: All Oregon employers, even those submitting W2 information electronically, are required to submit the Form WR (Oregon Withholding Annual Reconciliation Report) at the end of the year. The WR reconciles what you reported on Form OQ with the total withholding figures reported on W2's/1099?s for state taxes. This form can be downloaded from our website @ http://www.oregon.gov/DOR/BUS/forms-payroll.shtml. The WR is required to be filed by February 28, 2010. However, if you submit your W2 information electronically, you can submit the WR by the extended due date of March 31st. If you are reporting a substantial change on the form WR or are asking for a large refund due to errors that have occurred throughout the year, it is very important to prove and explain those changes. Failure to do so may result in refund delays. This is a purported Chinese proverb and curse. The current economic downturn and its transcendent transformation process on state government certainly qualify from my perspective as ?interesting times.? Many may view these times from a curse perspective, especially given the attendant difficulties and negative outcomes. I prefer to view these times with the same light offered by many proverbs; with the intent to be taught and instructed on fundamental principles, which, if followed, can prevent future misery and yield a large measure of good. The key is to determine what we are going to do with our circumstances and opportunities, then do it. Government Withholding Relief Coalition Continues Push to Repeal 3% Withholding Requirement The Government Withholding Relief Coalition, of which NASACT is a member, is continuing its push on Capitol Hill to repeal the three percent withholding requirement. The provision, which was passed in 2006, would require federal, state and local governments to withhold three percent on most payments including Medicare payments, farm payments, and certain grants. Help Repeal the 3% Withholding Requirement NASACT is asking all members to contact their congressional delegations to ask for support of these important provisions. A draft letter template is available on NASACT?s website at www.nasact.org/washington/annoucements.cfm. Please include in your letter specific information about potential costs to your state, as Congressional members have requested cost estimates when discussing the provision previously. Contact information for senators can be found at www.senate.gov and representatives at www.house.gov. Previously, payments to corporations were exempt from the reporting requirement. State Groups Come Together to Get the Facts Out on Bankruptcy, Defaults and Public Pensions State and local government organizations have come together to get out the facts on the condition of municipal finance in response to a bevy of news reports and congressional interest in the matter. Neil Abercrombie to serve as director of the state?s Department of Budget and Finance, was confirmed on February 15 by the Hawaii?s Senate for the position. David Lillard Named to NASACT?s Executive Committee David H. Lillard, Jr., was recently named to fill a vacancy on NASACT?s Executive Committee. NASACT Becomes a Supporting Organization of Values and Guiding Principles of Public Procurement NASACT recently joined the National Institute of Governmental Purchasing, and several other public sector organizations, on a collaborative effort to develop standards of practice for public procurement. Procurement is a valuable component of successful government operations and it serves many stakeholders, including NASACT?s members. Blue-Ribbon Panel Addressing Standards for Private Companies Submits Recommendations to FAF In late-January, a blue-ribbon panel addressing how U.S. accounting standards can best meet the needs of users of private company financial statements issued a report of its recommendations to the Financial Accounting Foundation. The report calls for fundamental changes to the system of standard setting, including the creation of a new board, to be overseen by the FAF, that would focus on making exceptions and modifications to U.S. GAAP for private companies to better respond to the needs of the private company sector. The report also recommends the creation of a differential framework-a set of decision criteria-to facilitate a standard setter?s ability to make appropriate, justifiable exceptions and modifications. The report does not advocate a move toward a separate, self-contained GAAP for private companies or a comprehensive reorganization of GAAP. Decline in Bond Market Has States Nervous Illinois plans to sell $3.7 billion in pension obligation bonds this week, as part of Governor Pat Quinn's plan to address the state's persistent budget deficits. The last three months have not been pretty in the municipal bond market. Spooked by predictions of government bankruptcies and defaults, investors - especially those in big mutual funds - have fled the field, selling off $20 billion worth of state and local bonds in the process. The exodus, in turn, has left states that need to borrow wary. The number of new offerings from state and local governments is down to a level not seen in 11 years. Basically, as panicked investors sell off their old bonds on the street, states have not restocked the shelves in the market by issuing new ones. All this turmoil could cost taxpayers money. Interest rates on the highest-rated municipal bonds are up by more than one-third since late August, notes Kinney Poynter, the director of the National Association of State Auditors, Comptrollers and Treasurers. As rates go up,'states have to pay more to issue their debt,' Poynter says, 'which means citizens have to pay more for infrastructure projects like roads, schools, etc. So it's had a dramatic effect.' - Daniel C. Federal News GASB Proposes Guidance for Applying Termination of Hedge Accounting Provisions The Governmental Accounting Standards Board (GASB) issued its Exposure Draft (ED), Derivative Instruments: Application of Hedge Accounting Termination Provisions (an amendment of GASB Statement No. 53). The deadline for submitting written comments on the ED is April 15, 2011. GASB Statement No. 53, Accounting and Financial Reporting for Derivative Instruments, provides for the use of hedge accounting for derivatives that are effective hedges. Hedge accounting entails reporting fair value changes of a hedging derivative as either deferred inflows or deferred outflows of resources, rather than recognizing those changes in investment income. The Statement requires that hedge accounting cease, and all accumulated deferred amounts be reported in investment income, when a hedging derivative is terminated. Read more. Study: One-fourth of Federal Websites Surveyed Rank High in Transparency A quarter of federal websites surveyed scored high in online transparency, which also was found to be associated with high ratings for customer satisfaction and participation, according to a new study from the research firm ForeSee Results. For the eight of 32 federal websites that scored 80 or higher on a 100-point transparency scale in 2010, there is a strong correlation with customers being more satisfied, more likely to rely on the website as a primary resource of information and more likely to recommend the website to others, Foresee said in a report issued Feb. 22. Federal Agencies, Contractors Preparing for Government Shutdown Federal agencies continued reviewing shutdown plans Wednesday in anticipation of a possible closure of the federal government that could begin as early as next week. Most of this week's planning probably revolves around determining which employees would need to work, according to Barry Anderson, a budget expert who handled shutdown-related concerns for the Office of Management and Budget during the Clinton-era closures. A series of memos written by Attorney General Benjamin Civiletti in the closing days of Jimmy Carter's administration still dictate how agencies should make those determinations. As the baby boomers retire and reach their disability-prone years, Social Security's workloads continue to grow. In addition, the economic downturn has greatly increased the demand for our services. Despite this dramatic growth in our work, through increased employee productivity, new initiatives, and improved funding we have reversed a trend of declining service and an increasing backlog in our disability workloads. The President's fiscal year (FY) '12 budget request of $12.5 billion for Social Security's administrative expenses will allow us to maintain staffing in our front-line components, fund ongoing activities, and cover our inflationary increases. It will allow us to reduce our hearings and initial disability claims backlogs, and to continue to reverse the decline in our program integrity work. Full funding by Congress of the President's FY '12 budget request is critical. It's the minimum the agency needs to continue to reduce key backlogs and to increase deficit-reducing program integrity work. Social Security Joins National Consumer Protection Week 2011 Social Security is joining with Federal, State, and local government agencies and national organizations to recognize March 6-12, 2011 as National Consumer Protection Week (NCPW). Astrue, Commissioner of Social Security, will hold the seventh Compassionate Allowances Outreach Hearing. The subject of the hearing is autoimmune disease. People with autoimmune disease suffer from overactive immune responses. Generally, the immune system mistakes part of the body (substances and tissues normally in the body) for an infection and attacks. Essentially, the body is attacking its own cells. Compassionate Allowances are a way of quickly identifying diseases and other medical conditions that invariably qualify under the Listing of Impairments based on minimal objective medical information. Compassionate Allowances make it possible for Social Security to quickly identify the most obviously disabled individuals for allowances based on objective medical information that we can obtain quickly. (Back to Top) Electronic Payments Are a Must For years, Social Security has stressed the convenience, security, and safety of getting benefit payments electronically. Soon, electronic payments will not only be the best way to receive Federal benefits it will be the only way. That's because the U.S. Department of the Treasury announced a new rule that will extend the safety and convenience of electronic payments to millions of Americans and phase out paper checks for Federal benefit and non-tax payments by March 1, 2013. In fact, effective May 1, 2011, all new recipients of Federal benefits, including those filing for Social Security and Supplemental Security Income (SSI), must receive their payments electronically. Electronic payments are safer, easier, more reliable, less costly, and good for the environment.
