From Laura.Allran at ode.state.or.us Mon Dec 7 08:49:03 2009 From: Laura.Allran at ode.state.or.us (ALLRAN Laura) Date: Mon, 7 Dec 2009 08:49:03 -0800 Subject: [SE-Dir] OSL&P: OSB Transition Students Message-ID: TO: All District and ESD Special Education Directors The message below is being sent to you on behalf of: Nancy Latini, PhD Assistant Superintendent Student Learning & Partnerships ______________________________________________ December 7, 2009 RE: Transition of OSB Students I wanted to follow up with you regarding House Bill 2834, the closure of the Oregon School for the Blind, and the transition of OSB students back to your districts. Some questions have recently risen related to funding to pay for the educational services of these former OSB students. House Bill 2834 created the "Blind and Visually Impaired Student Fund" and included a roughly three million dollar appropriation to cover educational costs for school districts that the State School Fund, High Cost Disability Fund, or federal funds would not cover for former OSB students. It should be noted that the Fund is "supplemental" and not intended to "supplant" other funding sources; districts are expected to use their regularly appropriated funds before asking for additional reimbursements from the fund. No school district should be faced with unfunded educational expenses, even if a student's educational plan requires a full-time aide or attendance at the Washington School for the Blind. Once the school district IEP team decides upon the most appropriate placement, the district would use their state school fund money and go through the high cost disability fund process. The legislative intent of HB 2834 was that if there are educational expenses that exceed what you receive from these sources, you would then seek and receive the difference out of the Blind and Visually Impaired Student Fund. The bill needs a technical fix to clarify that any funds expended by the school district between their double weighting for special education and the $30,000 "bar" for high cost funds are covered. We have spoken to the Chair of the House Education Committee, Representative Gelser, and she is aware of the need for the fix and we are working with her to pass legislation in February to make this technical change to correctly incorporate the legislative intent. This fund is overseen by the Northwest Regional ESD, who was appointed by Superintendent Castillo to take the lead on such funding requests. They also communicate with ODE about requests for reimbursement from the fund. You can contact Joan Steiner at NWRESD (503-614-1275) or Eric Richards at ODE (503-986-5786) if you have further questions regarding this matter. I hope that this communication eases your worry about funding. There are sufficient funds to pay for the education costs of former OSB students which should assist with the planning process for these students and the IEP teams. This grant is specified for activities related directly to special education professional development efforts. These enhancement grants come from ODE discretionary IDEA funds. Over the past few years, we have determined that part of ODE's federal allocation, which does not get distributed through formula, should be shared with you to direct the activities you need to accomplish. 1. Please understand that this is in addition to your IDEA formal flow through allocation and should not be confused with that allocation. 2. The allocations are the same as last year, plus a 2% increase. 3. You recently received funds for extended assessment efforts earlier so these funds are in addition to that allocation. 4. You also received funds for SPR&I which are in addition to this allocation. 5. This enhancement grant, similar to last year, may be used for such things as: a) RTI efforts, b) PBS efforts, c) expanded SPR&I activities and improvement planning, d) determination issues, e) other trainings specifically related to support for students with disabilities, and f) other activities that enhance the understanding of and process for special education. The funds from this grant may not be used to purchase equipment, or to pay for existing staff payroll or benefit costs. Substitute costs which enable select staff to attend trainings are allowable expenses on this grant. Please consider a plan for spending these valuable funds in a timely manner. Waiting until the last minute does not benefit students or staff in their efforts to enhance instruction or support. The last day to encumber these funds will be September 30, 2010. You may direct any questions related to these funds to Eric Richards at eric.richards at state.or.us or 503-947-5786. This basic information will provide you and your staff an understanding of the exemption. Feel free to share this information as appropriate in your district. The Oregon Tax Code provides an additional tax exemption for parents of children with disabilities in Oregon. The procedure for claiming an exemption for the 2009 tax year is explained in the Oregon Individual Income Tax Return and Instructions, Nonresident and Part-Year Resident, and the Full-Year Resident booklets. Who qualifies for the exemption? A child qualifies if he or she meets all of the following: * Qualify as your dependent for tax year 2009; and * Be eligible for "early intervention services" or receive special education as defined by the State Board of Education of the state where the child attends school, and * Be considered to have a disability as of December 31, 2009 under the federal Individuals with Disabilities Education Act and related Oregon laws. For purposes of special education: * Learning disabilities and communication disorders do not qualify. * Eligible disabilities include: * Autism * Visual Impairment * Mental retardation * Serious emotional disturbance * Traumatic brain injury * Hearing impairment * Orthopedic impairment * Other health impairment * Multiple disabilities * Deafblind What documentation must be submitted with a tax return? The tax booklet explains that your child must have an Individualized Education Program (IEP) or an Individualized Family Service Plan (IFSP) and an eligibility statement for one of the disabilities listed above. A copy of the IEP or IFSP coversheet and a copy of the student's eligibility statement may be obtained from the school district. The coversheet and copy of the eligibility statement should be kept with the child's permanent health records, as maintained by the family - they DO NOT need to be sent with the tax return. Write the child's name on line 6c for "All dependents" as well as line 6d (see page 8 of the Oregon Department of Revenue Full-Year Resident Instructions or page 8 of the Nonresident and Part-Year Resident Instructions at the link below for complete instructions).
