These have been called enhancement grants and come from ODE discretionary IDEA funds. Over the past few years, we have determined that part of ODE's federal allocation, which does not get distributed through formula, should be shared with you to direct the activities you need to accomplish. 1. Please understand that this is in addition to your IDEA formal flow through allocation and should not be confused with that allocation. 2. Please know that in order to disseminate these funds as quickly as possible, we are using the same allocations as used last year. 3. You already received funds for extended assessment efforts earlier this year so these funds are in addition to that allocation. 4. This enhancement grant, similar to last year, may be used for such things as: a) RTI efforts, b) PBS efforts, c) expanded SPR&I activities and improvement planning, d) determination issues, e) other trainings specifically related to support for students with disabilities, and 7) other activities that enhance the understanding of and process for special education. The funds from this grant may not be used to purchase equipment, or to pay for existing staff payroll or benefit costs. Substitute costs which enable select staff to attend trainings are allowable expenses on this grant. Please consider a plan for spending these valuable funds in a timely manner. Waiting until the last minute does not benefit students or staff in their efforts to enhance instruction or support. The last day to encumber these funds will be September 30, 2009. No districts or ESDs in Oregon have approval to use alternate IEP forms for the 2008-2009 school year. Any districts and ESDs who received prior ODE approval for alternate IEP forms must reapply for approval of any alternate IEP forms if they decide not to use the Oregon Standard IEP. The Oregon Standard IEP form is available in two formats: for students age 15 or younger when the IEP is in effect; and for students age 16 and older when the IEP is in effect (transition age students). To review the Oregon Standard IEP form, go to http://www.ode.state.or.us/search/page/?id=1163. Beginning immediately, districts and ESDs have the opportunity to apply for approval for use of an alternate IEP form. Districts and ESDs intending to submit an alternate IEP form for approval must notify the Department by a formal letter of intent to be received by ODE no later than February 20, 2009. If a district or ESD intends to submit an alternate IEP form for approval, the alternate IEP form and rationale worksheet(s) must be attached to the letter of intent. The following information and attachment should assist in clarifying that amendment. Please know that ODE submitted a proposed change in statute to reflect this amendment. Immediately following legislative approval, the Department will create rules to further explain the statute and ask for your input prior to any hearing. Final amendments to the 2006 IDEA, effective December 31, 2008, allow for parents to revoke consent for the continuing provisions of special education and related services at any time. Under this amendment, districts may not try to override a parent's decision to revoke consent but must receive the parent's written revocation decision and districts must provide prior written notice that they will honor the parent's revocation request. A district may request a meeting with the parent to discuss the revocation; however, districts are prohibited from requiring attendance at such a meeting or imposing other conditions that delay or deny the termination of services. Mediation or due process may not be used by the district. The district must, in their written notice, be clear that the child will no longer receive special education and related services or the protections provided by the IDEA procedural safeguards - including the discipline protections. The written notice must be sent after the parent revokes consent and a reasonable period of time before the district terminates the provision of special education services to the child. Remember: (1) A district will not be considered in violation of the requirement to make FAPE available to the child as a result of terminating special education and related services following the revocation of parental consent for such services. (2) A district is not required to convene an IEP team meeting or develop an IEP for a child whose parent has revoked consent for the continued provision of special education and related services. The attached sample form will assist you should you get such a request. This form will be posted on the ODE web site along with the other sample forms. I am also grateful for the work of the OSBA task force that worked with ODE to develop this document, as it will make this year's exercise much easier for you. In particular, the efforts of Claire Doolittle in her extraordinary job developing this document. And to Don Staehly for chairing and coordinating an excellent work group along with Angie Peterman. So the time is upon on us, which is my purpose in writing. Attached you will find the following documents; 1) The above mentioned spreadsheet, with tab instructions, to assist you in the calculation. Please note it is not mandatory that you use this spreadsheet, it is a tool developed to be helpful for you should you choose to utilize it. As you know, you use the October ADM count for your total student body count. (See second attachment) Last year these calculations were due in on January 31, 2008. This year the due date will be March 31, 2009. Because we have lengthened the time for you to complete the calculation, and moved the due date back considerably, it is important that you complete this federally required exercise by the stated due date. The economy is hitting everyone hard. Many of you are wondering about being able to spend at the same level as last year for this calculation. Please remember that this is not the same as maintenance of effort. The object here is to ensure the Feds that you are spending at least the same amount per child on an IEP in your basic costs of operating your district and providing education as you would spend on a child in General Education. Only then can the money being provided through IDEA truly be considered as covering excess costs of providing special education and related services for kids on IEPs, and not supplanting basic educational expenses that would be incurred even if IDEA funds were not granted.
