RE:  Approval Process for Alternate IEP Forms

Under Oregon Administrative Rule (OAR) 581-015-2215, all districts and ESDs in Oregon must use the Oregon Standard IEP form, unless they have applied for and been granted approval for use of an alternate IEP form by the Oregon Department of Education (ODE).  No districts or ESDs in Oregon have approval to use alternate IEP forms for the 2008-2009 school year.  Any districts and ESDs who received prior ODE approval for alternate IEP forms must reapply for approval of any alternate IEP forms if they decide not to use the Oregon Standard IEP.

The Oregon Standard IEP form is available in two formats: for students age 15 or younger when the IEP is in effect; and for students age 16 and older when the IEP is in effect (transition age students). To review the Oregon Standard IEP form, go to http://www.ode.state.or.us/search/page/?id=1163.

Beginning immediately, districts and ESDs have the opportunity to apply for approval for use of an alternate IEP form.  Districts and ESDs intending to submit an alternate IEP form for approval must notify the Department by a formal letter of intent to be received by ODE no later than February 20, 2009.  If a district or ESD intends to submit an alternate IEP form for approval, the alternate IEP form and rationale worksheet(s) must be attached to the letter of intent. Submissions received after 5:00 p.m. on February 20, 2009 will not be considered.  The ODE will complete the alternate IEP form review process and notify districts and ESDs by March 2, 2009 on the status of their submission.  Districts and ESDs whose alternate IEP form is not approved will have the option to request the Department reconsider that decision and resubmit their alternate IEP form with the recommended changes within 30 days of that decision (no later than March 31, 2009).  Only one resubmission is permitted per district/ESD.  If requested, the Department will provide technical assistance to school districts/ESDs in preparing the resubmission.  Districts will be notified within 30 days of resubmission, and no later than April 10, 2009 as to the status of their revised alternate IEP form.
