This is just a reminder about getting parental consent for Medicaid. I was in a meeting earlier this week and was told that apparently there is still some thought that schools need to get parental consent every time Medicaid is tapped and not just on an annual basis. Because there are a number of new directors since this letter of clarification (attached) was issued by OSEP, I am sending it again. I was told that in some places there has been pressure from state/regional Medicaid offices to get parental consent more frequently. I would remind you that this is an IDEA requirement and not a Medicaid regulation. Scholarship recipients will enroll in the Oregon cohort of the Speech Language Pathology Masters degree program through Nova Southeastern University (NSEU). During the 2007 Regular Legislative Session, House Bill 3141, Section 19 (12), was passed by the 74th Oregon Legislative Assembly. Each biennium, the Department of education may expend up to $150,000 from the State School Fund for the administration of a program to increase the number of speech-language pathologists and speech-language pathology assistants under sections 21 to 25 of this 2007 Act. Through HB 3141 funding, fifty-nine (59) Oregon educators have already been awarded scholarships for further education in Speech Language Pathology, a field identified with a severe shortage of professionals. These fifty-nine speech language pathologists and speech language pathology assistants are currently working in Oregon school districts and, at the same time, are in professional development programs which will result in appropriate professional certification. Districts/ESDs from across the state are involved with the SLP and SLPA cohort programs, and many of the districts are located in the rural sections of the state. Even before the cohort members have completed their programs, the members are sharing their newly-honed skills in Oregon schools. We are anxious to begin an additional Oregon cohort, and invite your district or ESD to apply. The application deadline is October 1, 2010. The SLP program begins in February 2011. The May 2010 Procedural Safeguards Notice will replace the October 2007 version and has been updated to reflect changes that have take place since the publication of the prior version. As in prior years, ODE will be providing three versions of the notice: a version for parents of children receiving Early Intervention and Early Childhood Special Education, a version for parents of school-aged children, and a version for adult students. The number of bulletins shipped to districts and programs will be based on the December 2009 Special Education Child Count including a small surplus; additional copies can be requested from ODE as necessary. The only substantive change from the prior version affected the section on parental consent for the provision of special education and related services. That section has been revised to clarify, consistent with federal regulations, that parents and adult students may revoke consent for the provision of special education services at any time during the delivery of those services. Other changes were limited to updating contact information and addressing minor editorial issues. The May 2010 Procedural Safeguards Notice contains the most accurate information for parents and adult students. Therefore, upon release of the new version, copies of the October 2007 version should no longer be distributed and should be destroyed. ODE is projecting an August delivery date for English language copies of the three versions of the May 2010 Procedural Safeguards Notice. ODE will also be providing districts and programs with copies of the notices in Chinese, Russian, Spanish, and Vietnamese. ODE is projecting an early September delivery for the non-English language copies. Please find a copy of the English versions of all three documents attached to this message. After districts and programs have received hard copies of the May 2010 Procedural Safeguard Notice, ODE will post all versions and translations of the notice on the ODE website.
