It also required a change in terminology from mentally retarded individual to an individual with an intellectual disability. These changes were made without any intent to change eligibility, rights, responsibilities, or definitions or to compel states to change terminology in state laws. As you also may know, many Oregonians have long desired to see this change in terminology and a decision has been made to act on that change. There is currently a bill at the legislature to provide authorization to change the terminology in Oregon statues and rules. Immediately following passage of that bill and subsequent changes, we will be changing any data systems and documents coming out of our office, including the special education sample forms located on the ODE website. Staff is currently in the process conducting searches to find where those changes are necessary. For example, one surprise is that the term mental retardation is not located in the Parental Rights/Safeguards document yet is located in several other documents that contain lists of disabilities. The majority of changes will be completed upon passage of the bill. You will be notified as soon as the bill becomes law and the changes are made to ODE documents and data systems. I know you will need to take steps to make necessary changes in the terminology, particularly with vendors who provide your IEP systems. You should be aware that we are targeting the end of the 2011-12 school year (and the very latest fall of the 2012-13 school year) for all current IEPs and related assessments to reflect this change. We wanted to give you this heads up to begin considering these changes. This is a monumental change for children, youth, and adults with cognitive disabilities, and we applaud Congress, the President, and the Oregon legislature for acknowledging the importance of this change. P.S. For those of you with major shifts in IEP vendors we are trying to assist in getting these changes made. Please note the message below to tech staff from Doug Kosty about the importance of having special education representation on the planning committees: "I am certain that you will include all types of end-users as you move forward with requirements gathering for the RFP, however I want to call your attention to a recent example. There has been a change in the terminology for what is known as Rosa's Law (mentally retarded to intellectual disability)and concerns have been raised with respect to computer vendors ability to appropriately codify these changes. Please take the time to engage Special Education experts as you develop your requirements to ensure this issue is appropriately addressed." This basic information will provide you and your staff an understanding of the exemption. Feel free to share this information as appropriate in your district. The Oregon Tax Code provides an additional tax exemption for parents of children with disabilities in Oregon. The procedure for claiming an exemption for the 2010 tax year is explained in the Oregon Individual Income Tax Return and Instruction booklets. Who qualifies for the exemption? A child qualifies if he or she meets all of the following criteria: * Qualifies as your dependent for tax year 2010; * Is eligible for early intervention services, or receives special education as defined by the State Board of Education of the state where the child attends school; and * Is considered to have a disability as of December 31, 2010 under the federal Individuals with Disabilities Education Act (IDEA) and related Oregon laws. As per Oregon Revised Statute (ORS) 316.099, children receiving special education services for communication disorders and learning disabilities do not qualify for this tax exemption. Eligible disabilities include: * Autism (82) * Visual Impairment (40) * Mental retardation (10) * Serious emotional disturbance (60) * Traumatic brain injury (74) * Hearing Impairment (20) * Orthopedic impairment (70) * Other health impairment (80) * Deafblind (43) * Multiple disabilities (two or more otherwise qualifying disabilities) What documentation must be submitted with your tax return to qualify for this exemption? The tax instruction booklet explains that your child must have an Individualized Education Program (IEP) or an Individualized Family Service Plan (IFSP) and an eligibility statement for one of the disabilities listed above. A copy of the IEP or IFSP coversheet and a copy of the student's eligibility statement may be obtained from the school district. The coversheet and copy of the eligibility statement should be kept with the child's permanent health and education records, as maintained by the family - they DO NOT need to be submitted with your tax return. Parents may wish to store an additional copy with their 2010 tax records. To claim the exemption on your 2010 state taxes, write the child's name along with the names of all other dependents on the line titled "All dependents" (line 6c on Form 40). In addition, write the child's name on the line provided for "Disabled children only" (line 6d on Form 40). Any districts or ESDs who received prior ODE approval for alternate IEP forms must reapply for approval of any alternate IEP forms if they decide not to use the Oregon Standard IEP. As you know, this is a federally mandated report under IDEA 2004, and districts must complete the calculation and meet the excess cost requirement at both elementary and secondary levels in order to retain their IDEA funds for 2010-2011. A work group of excellent school district business managers from around the state have provided our office with an improved template that makes it much easier to complete the calculation. In many districts the business manager completes this calculation, so we will be sending a copy of this message to all of the school district and ESD business manages as well. Because a failure by any district to complete the calculation will result in ODE being required to collect the equivalent of full repayment of district 2010-2011 IDEA grants, Superintendents will also receive a copy of this message. Attached you will find: 1. A spreadsheet, with tab instructions, to assist you in the calculation. It is not mandatory that you use this spreadsheet. It is a tool to help you should you choose to use it. If you do use it, please e-mail it to steve.w.smith at state.or.us, as it will aid in the review and verification of the data. Please note Tab 4 (ODE Final Submission) of the spreadsheet. It contains the shortened form onto which you will report your expenses for elementary and secondary, have signed and dated by an authorized official of your district, and mail the original document/signature to Steve Smith. 2. A guidance sheet explaining how to secure the correct SECC number for use in the calculation. As you know, the October 2009 ADM count is used for your total student body count. This year the due date will be March 16, 2011. The object of the excess cost calculation is to ensure that you are spending at least the same amount per child on an IEP as you would spend on a child in General Education with regard to basic costs of operating your district and providing education. Only then can the money being provided through IDEA truly be considered as covering excess costs of providing special education and related services for students on IEPs, and not supplanting basic educational expenses that would be incurred even if IDEA funds were not granted. Federal law prohibits the use of your IDEA funds before you spend at this level in basic costs.
