House Bill 2283, signed into Law on June 9, 2011 and effective July 1, 2011, makes significant changes to the statutes related to modified diplomas, extended diplomas, and alternative certificates.  The revised Statute specifies:
1.      Who must give consent for a student to be placed on a path other than a regular diploma.
2.      Students on a path other than a regular diploma have the right to pursue their path for the later of 4 years beginning in grade 9, or until age 21 if they are permitted to continue attending school under federal law.  A waiver of this provision is available but cannot be less than 3 years to achieve the pathway; school districts must inform the Superintendent of Public Instruction of any such waivers.
3.      Students on one of the three optional pathways must have access to the minimum number of instructional hours provided to a student on a regular diploma path (i.e. 990 hours/year.)  The bill does continue to allow the student's IEP team to determine if less than 990 hours is appropriate for the student, based on the student's needs and performance level,  but prohibits school districts from unilaterally going below 990 hours for every student on an optional pathway.
4.      Districts must have on-site access to appropriate resources to achieve a high school diploma, a modified diploma, an extended diploma or an alternative certificate at each high school in the school district or public charter school.
