This series provides a great resource for districts and programs looking for professional development opportunities for their staff. The 2012-2013 NASDSE Professional Development Series fall sessions are now available for viewing on ODE's website This information must remain within the state and should not be posted on public websites at any time. The Department will continue to provide DVD copies of the broadcasts for rebroadcast and/or dissemination by ESDs and school districts. The NASDSE conference is accessible using a web-delivery system: 1. Open your web browser to http://pd.nasdse.org/. 2. Click on the conference you would like to view. 3. You will be taken to a screen that asks for an access code. 4. The access code will not change throughout the series. 5. Deputy Superintendent Rob Saxton has been charged with developing a plan for implementation of changes that would achieve the goals of this budget. We are aware there is significant concern about changes that would affect special education funding and services. We share your concern regarding changes that would negatively affect a local district's special education Maintenance of Effort (MOE) requirements. The two ways that ESD resources impact local MOE are: a. Provision of services directly to districts. These are typically referred to as "resolution" services, and the ESD establishes a dollar value for those services. Those expenditures are reported to Oregon Department of Education (ODE) to be included in the MOE calculation for audit purposes. b. "Flow-through" or "transit dollars," that are provided to districts. While these dollars typically are used as general fund dollars, and are not necessarily earmarked for special education, these funds are important resources that are frequently used to contract back with the ESD for special education services. Deputy Superintendent Saxton fully understands the impact that changes to these funds would have on districts' ability to meet MOE. We want you to know these issues are being taken very seriously and will be addressed in any proposal. Sarah joined our office in September as Director of Special Education Monitoring Systems and Outcomes. Prior to coming to ODE, she was an administrator of student services and special education programs in Federal Way, and more recently, Gig Harbor, Washington. You will enjoy working with Sarah as much as we at ODE do, and I know you will welcome her into this role warmly. ************************************************************ RE: Rule Revision to Reconsider IDEA Final Orders On January 24th the State Board of Education adopted the temporary rule revision to OAR 581-015-2030(14). This will enable the Oregon Department of Education (ODE) to reconsider IDEA Final Orders within 60 days of issuance of an order. The rule allows for either party to a complaint to ask for a reconsideration of the Department's order. The Department has discretion in deciding whether or not to conduct a reconsideration. If the Department does agree to reconsideration, it is important to note that the rule requires that any corrective action required in the order must be implemented according to the original order and not delayed during the reconsideration. This is a requirement of the Federal Office of Special Education. We hope this process continues our focus on successful low level dispute resolution. The Department of Education will also begin work on crafting a permanent rule to adopt in support of this change during the next few months. ODE will send a message to the field when the draft permanent rule is submitted to the Board of Education and also notify you when the applicable IDEA public comment period is in effect. You are encouraged to comment on the proposed permanent rule when the Department puts it out for public comment in the coming months.
