Dear Friends and Colleagues,

I am delighted to announce that beginning Friday, February 1, Dr. Sarah Drinkwater will assume the position of Interim Assistant Superintendent for the Office of Student Learning and Partnerships.  Sarah joined our office in September as Director of Special Education Monitoring Systems and Outcomes.  Prior to coming to ODE, she was an administrator of student services and special education programs in Federal Way, and more recently, Gig Harbor, Washington.

You will enjoy working with Sarah as much as we at ODE do, and I know you will welcome her into this role warmly.

RE: Rule Revision to Reconsider IDEA Final Orders

On January 24th the State Board of Education adopted the temporary rule revision to OAR 581-015-2030(14). This will enable the Oregon Department of Education (ODE) to reconsider IDEA Final Orders within 60 days of issuance of an order. The rule allows for either party to a complaint to ask for a reconsideration of the Department's order.  The Department has discretion in deciding whether or not to conduct a reconsideration.

If the Department does agree to reconsideration, it is important to note that the rule requires that any corrective action required in the order must be implemented according to the original order and not delayed during the reconsideration.  This is a requirement of the Federal Office of Special Education.

We hope this process continues our focus on successful low level dispute resolution.

The Department of Education will also begin work on crafting a permanent rule to adopt in support of this change during the next few months. ODE will send a message to the field when the draft permanent rule is submitted to the Board of Education and also notify you when the applicable IDEA public comment period is in effect. You are encouraged to comment on the proposed permanent rule when the Department puts it out for public comment in the coming months.
