Feel free to share this information as appropriate in your district and with parents. 2014 Tax Exemption for Parents of Children with Disabilities The Oregon Tax Code provides an additional tax exemption for parents of eligible children with disabilities in Oregon. The procedure for claiming an exemption for the 2014 tax year is explained in the Oregon Individual Income Tax Return and Instruction booklets. Who qualifies for the exemption? A child qualifies if he or she meets all of the following criteria: * Qualifies as a dependent of the parent(s) for tax year 2014; * Is eligible for early intervention services (birth to age 3), early childhood special education services (ages 3 to 5) or receives special education as defined by the State Board of Education of the state where the child attends school; and * Is considered to have a disability as of December 31, 2014 under the federal Individuals with Disabilities Education Act (IDEA) and related Oregon laws. What documentation must be submitted with the tax return to qualify for this exemption? As the tax instruction booklet indicates, the child must have an Individualized Education Program (IEP) or an Individualized Family Service Plan (IFSP), as well as a current eligibility statement as a student with a disability. If you do not have these documents contact your District for a copy of the IEP/IFSP cover sheet, and eligibility statement. Copies of the IEP/IFSP cover sheet and eligibility statement are not required to be submitted with the tax return. However, parents are advised to retain a copy with their 2014 tax records as the Oregon Department of Revenue may ask the parents to provide such documentation. The passage of this act is the first reform of the public workforce system in more than 15 years and it updates and modernizes many youth programs. WIOA also strengthens the collaboration between schools and Vocational Rehabilitation to better serve youth with disabilities. In anticipation of the impact WIOA will have on the provision of services to school age youth, Vocational Rehabilitation (VR) and the Department of Education (ODE) have begun to work together on clarifying the roles and responsibilities for local VR and Local Education Agency's (LEA's) under WIOA. Local VR and LEA's will be jointly responsible for implementing the services identified under WIOA with guidance from the state. In the coming year VR and ODE will provide collaborative trainings to ensure that local VR and LEA's are prepared to take advantage of the opportunities provided by WIOA to achieve the highest outcomes for students with disabilities in Oregon. It is important to understand that proposed federal regulation and guidance for the implementation of WIOA are expected to be early in 2015. Following the publication there will be a public comment period followed by formal adoption of the rules and full implementation will not occur until early 2016. We know that there is a great deal of information and misinformation about the impact of WIOA out in the field and people are wondering what it means for their program. We want to reassure you that VR and ODE will be providing guidance and support as WIOA regulations become formalized over the next year and we will be providing regular updates as new information becomes available.
