RE: Executive Numbered Memo 004-2017-18
Senate Bill 263: Abbreviated School Day Notice and Acknowledgment Form
TO: Superintendents, Principals and Special Education Directors
FROM: Sarah Drinkwater, Assistant Superintendent, Office of Student Services
DATE: September 18, 2017
Effective July 1, 2017, Senate Bill (SB) 263 sets forth new requirements relating to the placement of students on abbreviated school day programs. With certain exceptions (e.g., discipline in compliance with existing law, home schooling), students who do not have Individual Education Plans (IEPs) must not be placed on abbreviated school day programs without parent consent. For students with IEPs, an abbreviated school day program may only be implemented after certain tasks are completed by the IEP team (placement determinations are made based on student need, parents are provided an opportunity to meaningfully participate, non-abbreviated school day program placement options are considered, and the IEP states in writing the reasons why the student was placed on an abbreviated school day program.)
A copy of SB 263 can be found here: https://olis.leg.state.or.us/liz/2017R1/Downloads/MeasureDocument/SB263/Enrolled
SB 263 also contains a notice and acknowledgement provision. At least once per term, districts must provide written notice to, and obtain signed acknowledgement from parents regarding abbreviated school day program rules and processes. Please find attached proposed language for districts to incorporate into their notice and acknowledgement forms.
