Our county counsel is of the opinion that we can require employees to wear masks but cannot require members of the public to, given that we're a public building. He said that we can strongly encourage people, too, though, through signage and individual conversations, especially with people who are visibly coughing/sneezing, etc.

Has anyone consulted legal consul regarding a requirement for employees to wear face masks? I see in the state draft that is says to check and see if that is possible. It also uses the language “encourage”. This was in the reopening guidance for retail stores.



Strongly encourage all employees and customers to wear cloth face coverings. If a store sets a policy that all employees and customers are required to wear cloth face coverings, store management should consult with their legal counsel to determine whether or not such a requirement can be enforced and whether they will provide cloth face coverings for those who do not bring their own
