Dear SHLB Members,

The 5th Circuit Court of Appeals en banc just found by a 9-7 vote that the current Universal Service Funding mechanism is unconstitutional.  We are still digesting the decision.  But our lawyers assure us that the current USF process - including E-rate and Rural Health Care - continue in effect.  The 5th Circuit Court remanded to the FCC for further proceedings but did not "vacate" the USF funding mechanism.

This decision creates a split among the circuit courts (we won in the 6th and 11th circuit) which increases the chance that the Supreme Court will take up the case down the road.

The government is likely to file a request to stay the effect of the decision.  We will keep you posted.
