Marine Board Opens Rulemaking and Elects New Board Chair
The Oregon State Marine Board met on June 26 to consider several proposed rules and to elect a new Board Chair and Vice-Chair for the 2013-2014 year. The Marine Board meeting was held at the Marine Board office, 435 Commercial Street NE, in Salem.
The Marine Board approved initiating rulemaking to comply with the laws passed during the 2013 Oregon Legislative session:
~ OAR 250-020-0221 Boat Operations in Lane County and OAR 250-030-0030 Scenic Waterways;
~ OAR 250 Division 014 Marine Facility Program;
~ OAR 250 Division 015 Ocean Charter Vessels;
~ OAR 250 Division 016 Outfitters and Guides;
~ and OAR 250 Division 026 Abandoned Boats (this will be a new division).
The Marine Board approved opening rulemaking for OAR 250-020-0032, Boat Operations in Clackamas County on the Willamette River, to consider moving the slow-no-wake and wake enhancing device exclusion cutoff from the 219 Bridge to the east 2.5 mile to Champoeg Park. No other changes to the exclusion zone will be considered.
The Board adopted a slow-no-wake zone around the Portland-Milwaukie bridge construction project on the Willamette River. This rule provision will sunset upon removal of the temporary construction bridges or no later than September 30, 2014.
In response to a citizen petition to establish a slow-no-wake zone around private docks on Fern Ridge Reservoir, in a 3-1 decision, the Marine Board voted not to open rulemaking for Boat Operations in Lane County, OAR 250-020-0221. Instead, staff was directed to provide education on wake courtesy and work with petitioners on non-regulatory alternatives to address concerns.
The Board elected Brian Carroll to serve as Marine Board Chair and Jen Tonneson as Vice- Chair beginning July 1 through June 2014.
