Hello, All:
I was just told that the Yamhill County courts have already implemented a process where AT ARRAIGNMENT a Defendant charged with either a DV or sex offense who is going to remain in-custody is told by the judge about the prohibition of contact with the victim. This no-contact provision is also documented on an Order that the Defendant receives.
So, this is a reminder for those in a position to do so to speak with your Sheriff's Office and/or Presiding Judge/Trial Court Administrator about this new law and how your jurisdiction will implement it.
Hi All-HB 2925 was signed by the Governor on June 2, 2011 and, because of its emergency clause, is now in effect. Here's a link to the final bill: http://www.leg.state.or.us/11reg/measpdf/hb2900.dir/hb2925.en.pdf.
The main provisions are:
* Directs release assistance officers, release assistance deputies, and courts to issue no-contact orders against defendants charged with a sex crime or a crime constituting domestic violence to be in effect while the defendant is in custody awaiting arraignment or trial.
* Order prohibits defendant from contacting the victim while defendant is in custody.
* Upon petition of the victim, the court may terminate the order if the court finds, after hearing, that terminating the order is in the best interest of the parties and the community.
Violation of the Order is basis for a Contempt Charge.
ALSO (for those of you keeping track): The Strangulation bill (HB 2940) was supposed to make its way through the full Ways and Means Committee last Friday. There was apparently a typographical error/glitch of some sort in the Bill so it was carried forward (i.e. not heard that day). No word, yet, on when it will reappear. But, the current legislative session is due to end shortly, so it could be anytime. I will keep you updated. WE STILL EXPECT IT TO PASS.
