Gang-Related Violence, Exploitation, and Intimidation

Gangs are well known for the perpetration of violent and drug-related crimes but they also rely on crimes of violence against women and girls to exploit and control their victims and communities. Gang members use of violence against women and girls, including pimping, sexual assault, exploitation, and trafficking has become commonplace and the victims can be anyone, from a gang member's intimate partner to a female gang member, and even innocent bystanders. Gang members are also notorious for intimidating witnesses, and often go to great lengths, including murder, to prevent them from cooperating with law enforcement. The pervasive nature of gang-related violence against women and girls combined with the habitual use of witness intimidation present unique challenges to the effective investigation and prosecution of these cases.
This webinar is designed to overcome the challenges presented by gang-related violence against women and girls. It will discuss gang-related domestic and sexual violence, gang culture, and gang members as abusers. It will focus on the abduction, recruitment, and violence involved in the sexual exploitation and trafficking of women and girls. The presenters will also discuss victim-centered criminal justice responses, how to detect gang affiliation of victims or witnesses, reporting issues, lethality, courtroom security, recognizing and addressing intimidation, trial issues, and sentencing considerations.

Williams v. Illinois and Forensic Evidence:
The Bleeding Edge of Crawford

Prosecutors looking for clear guidance on how to satisfy the requirements of the Sixth Amendment's Confrontation Clause, as interpreted in Crawford v. Washington and its progeny, when the prosecution presents expert testimony that is based in part upon conclusions reached by other (non-testifying) experts or technicians have been disappointed by the United States Supreme Court's 2012 decision in Williams v. Illinois. Although the Court affirmed the defendant's convictions for sexual assault and related crimes, only four Justices joined the plurality opinion, with the fifth vote resting on an entirely different rationale. The absence of a majority opinion, along with the vigorous dissent joined by the remaining Justices, has raised more questions than it answers about when and how an expert may testify to conclusions based upon the opinions or work of other experts or technicians.

When and How: Admitting Expert Testimony on Victim Behavior in
Sexual Assault Cases in Pennsylvania

On June 29, 2012, Pennsylvania shed its distinction of being the only state in which expert testimony to explain victim behavior in sexual assault cases was inadmissible by enacting Section 5920 of the Judicial Code, "Expert testimony in certain criminal proceedings.", The law, which became effective on August 28, 2012, is a critical tool for prosecutors seeking to provide a context for understanding sexual assault and sexual assault victims, as well as to counter entrenched myths and misperceptions about sexual assault and sexual assault victims. These fallacies have been reinforced for centuries by public discourse, inadequate laws created by misguided and uneducated legislators, and nefarious defense strategies designed to discredit victims through the exploitation of common rape myths.
