I thought we talked about the topic of public records requests in a GPL meeting at some point in the last year or so.  I'd be interested to hear Cy's input on where GIS data falls on public records requirements.  But that's maybe a good conversation for a future GPL meeting.  I thought that draft data or unfinished data, unless shown to the public thereby exposing it to the public domain, was not subjected to public disclosure/public records requests. 

Nevertheless, I think Rudie's question is just about releasing unpublished data.  So yes, you could go the public records route.  I think a lot of agencies don't have a formal "publishing" process like DOGAMI, so whatever their typical data review process prior to making it publicly available applies.  Otherwise, I'll say for DLCD it would be up to our discretion to release it.  No formal policy.  We also use IAA or IGA's to have a documented relationship between government agencies for data sharing.  At DLCD, my position is responsible for all data sharing agreements, IAA's or IGA's that related to data/IT sharing.... keeping them, reviewing them, and approving them. The only formal piece to this is my position description.

I've been told to utilize Oregon's public records law. Its all public, with a few exceptions, and we're required to disclose or provide access to it on request. 

We've had a couple cases where meeting the request would have involved hours assembling different background/supplemental data. Those cases were part of larger requests and everyone involved had to provide estimates of the hours it would take to provide the material.
