Good morning, all -
As we communicated yesterday, the Oregon Court of Appeals has granted a temporary stay of Oregon Health Authority's temporary rules banning flavored vaping products. I'm writing with a brief update on what that means for Local Public Health Authorities and other local public health partners.
* Other components of the Governor's Executive Order are still in effect. The stay only applied to OHA's temporary rules banning sales of flavored vape products. The OLCC sales ban is still in effect for THC-containing products.
* At OHA, we're continuing with other activities in the Executive Order, including communicating the dangers of vaping and removing barriers for cessation. We are also preparing for education and enforcement should the stay be lifted. We encourage your programs to continue with public education about the dangers of vaping and the availability of cessation resources. The court action does not change the facts about the outbreak of vaping-associated lung injury nationwide, or our public health responsibility to keep the public informed. Nationally, CDC reports<https://www.cdc.gov/tobacco/basic_information/e-cigarettes/severe-lung-disease.html> nearly 1,500 cases and 33 deaths from vaping-associated lung injury.
* For updates, continue to check www.healthoregon.org/vaping<http://www.healthoregon.org/vaping>, including OHA's statement on the court stay. You can also view and subscribe to OHA news releases here: https://www.oregon.gov/oha/ERD/Pages/News-Releases.aspx and follow us on Facebook and Twitter to reshare our posts on the sales ban and court stay.
* If your program would like to have a conversation about prevention strategy during the stay, please reach out to me or your community liaison. The fluid situation at the state and national levels emphasize how important it is for local communities to take long-lasting, protective actions to protect their residents' health.
More information will be forthcoming.
Best regards,
Sarah W.
