Dear Local Public Health Administrators and Health Officers

This is an update on OHA's work to implement Governor Brown's Executive Order 19-09. Last week, the Oregon Court of Appeals implemented a stay on the sales ban of flavored nicotine vaping products.

The stay is still in place, and LPHAs and other agencies must cease any retailer education or enforcement activities until further notice from OHA.

In addition, planning for retailer outreach and education activities should stop until further direction is available from OHA as there are legal processes that are expected to take some time to be completed.

We do not expect any updates from the court this week. We will send you more information as it is available.
